Motion by Councilmember Beahen and seconded by Councilmember Zimmerman that the <br />Council not waive the monetary limits on municipal tort liability established by Minnesota <br />Statues 466.06. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Beahen, Zimmerman, and Haas <br />Steffen. Voting No: None. Absent: Councilmember Beyer. <br /> <br />5) Authorize Contract for Snow Plowing for Cul-De-Sac Route <br /> <br />It was noted that the Finance Committee recommends the execution of an agreement with <br />Kelly's Landscaping for cul-de-sac plowing. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Beahen that the <br />Council authorize the Mayor and City Administrator to enter into an agreement with Kelly's <br />Landscaping for cul-de-sac plowing during the 1998-99 snow season, at a cost of $50 per hour <br />subject to approval of the City Attorney to provide protection. <br /> <br />Further discussion: City Attorney Goodrich recommended the agreement be revised by changing <br />Section 4b to address payment to the contractor and Section 5A to add language to state the <br />contractor will be paid $50 per hour for actual snow plowing services provided. He noted this <br />will protect the City from going over budget since the contractor can be called out only when <br />directed by the City to proceed. Councilmembers Haas Steffen and Beahen agreed with a <br />friendly amendment to the motion to include the language as recommended by the City Attorney. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beahen, and <br />Zimmerman. Voting No: None.
