Motion carried. Voting Yes: Mayor Gamec, Councilmembers Beahen, Beyer, Haas <br />Steffen and Zimmerman. Voting No: None. <br /> <br />Case #16: Discuss Development Moratorium Ordinance <br /> <br />City Attorney Goodrich stated that earlier, Councilmember Haas Steffen inquired about a <br />pending action for the Planning Commission. He recommended that Council not discuss <br />the merits of the proposal but to discuss what the procedure of adoption of rezoning is. <br />There is a 60-day rule to approve or deny but the City can extend the 60 days. The <br />subject application was brought to the City on November 10. City Council cannot direct <br />the Planning Commission so they will need to proceed with this matter independent of <br />City Council. If the request is approved by the Planning Commission on December 3, the <br />matter will come before Council on December 8. In order to delay this action, the City <br />Council could adopt a moratorium. The moratorium can be put into place and we have <br />done that in the past. <br /> <br />Councilmember Haas Steffen stated she did not know who brought this forward but she <br />felt that someone should have had an idea that this is not the time to do this. She has <br />heard that there is an attorney involved and she does not what to be at a place where we <br />cannot do anything about this. <br /> <br />Mr. Goodrich stated that Council can place a moratorium on December 3, it would be <br />adopted on December 8, and it would be effective January 8. <br /> <br />Councilmember Haas Steffen stated that if the owner or developer of the property is <br />negotiating in good faith, she thought they would not initiate this action. Staff is also <br />looking at other sensitive areas. Maybe we should consider more than one area. We <br />might want to look at buffering issues. <br /> <br />Community Development Director Sherman stated that staff is looking at modifying the <br />proposed land-use plan as is in the current comprehensive plan. She added that this <br />application was initiated by the developer. <br /> <br />Councilmember Haas Steffen inquired if we should be notifying the people and their <br />attorney that the developer has gone ahead with this. <br /> <br />Ms. Sherman replied that they have been notified of the public hearing. <br /> <br />Councilmember Haas Steffen stated she is talking about a different issue. Should the <br />City Attorney be having conversation with their attorney and the group of people on a <br />civil matter. <br /> <br />Mr. Goodrich responded that he has had conversations with them, but not about rezoning. <br />He stated that he is talking tonight with Council to let them know they can place a <br />moratorium on the property.
