Motion by Councilmember Haas Steffen and seconded by Councilmember Zimmerman <br />to authorize the purchase of the properties needed in the specified amount for the purpose <br />of facilitating the Trunk Highway #47 project, contingent upon the issuance of the <br />Findings of No Significant Impact by the Federal Highway Administration and MnDOT <br />as required by the Federal and State requirements and that Mr. Jankowski begin talking <br />with Commissioner Denn about the traffic lights, etc. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Couneilmembers Haas Steffen, <br />Zimmerman, Beahen and Beyer. Voting No: None. <br /> <br />Case#5: Introduce Ordinance to Establish Development Moratorium on <br /> Certain Parcels within the City of Ramsey <br /> <br />City Attorney Goodrich stated that at the November 24, 1998 meeting, Council directed <br />staff to prepare a proposed moratorium ordinance for the property owned by Reilley <br />Estates. Staff drafted an ordinance anticipating it would be introduced at Council's <br />special meeting scheduled for December 3, 1998. There was no quorum present at that <br />meeting, however, so no action was taken. Mr. Goodrich presented the proposed <br />ordinance. We are considering this property (owned by Reilley Estates) and others with <br />regard to Ramsey's current comprehensive plan amendment. It would be appropriate to <br />adopt such an ordinance to allow the comp plan process to proceed. <br /> <br />City Administrator Norman reported that staff was originally going to recommend <br />against adoption of such an ordinance but now feels that adoption of this ordinance is not <br />a signal to one side or another to give them leverage in their negotiations. Perhaps the <br />City should follow these negotiations because maybe some of the items discussed should <br />have some City input, e.g., street access to the north of that subdivision, etc. <br /> <br />Councilmember Haas Steffen stated that we have a lawsuit on hold - papers have been <br />signed by both sides. <br /> <br />Mr. Goodrich stated that he has reviewed this issue with the counsel representing Ramsey <br />and also spoke with Mr. Dom, attorney for the group against the development, and a <br />representative from Reilley Estates. This will not particularly affect the lawsuit at this <br />time. <br /> <br />Councilmember Haas Steffen commented that the action that went before the Planning <br />Commission was to not rezone at this time. <br /> <br />Mr. Goodrich stated that they tabled the rezoning request. <br /> <br />Councilmember Haas Steffen inquired if Mr. Miller (Reilley Estates) can go forward with <br />any kind of legal action with regard to rezoning and not go forward with the action that <br />the League of Minnesota Cities is defending us on. <br /> <br />City Council/December 8, 1998 <br /> Page 5 of 13 <br /> <br /> <br />
