COMMISSION BUSINESS <br /> <br />Case #1: Appoint Chair and Vice-Chair for 1998 <br /> <br />Motion by Commissioner LaDue, seconded by Commissioner Terry, to appoint David Bawden as <br />Chairperson and Benjamin Deemer as Vice-Chairperson of the Planning Commission for 1998. <br /> <br />Motion Carried. Voting Yes: Vice Chairperson Deemer, Commissioners LaDue, Terry, and Jensen. <br />Voting No: None. Absent: Chairperson Bawden. <br /> <br />Case #lA: <br /> <br />Request for Site Plan Review; Case of Jamie Sharp <br /> <br />Zoning Administrator Frolik explained that Mr. Sharp is requesting site plan review to construct a <br />general contractor's office/warehouse facility in the Pineview Estates 2nd Addition PUD which is <br />zoned for a combination of residential and commercial uses. She stated Mr. Sharp is proposing to <br />construct a 1,064 square foot commercial structure to house his general contracting business, Cedar <br />Ridge Homes. Mr. Sharp is a full service general contractor providing home construction, insulation, <br />landscaping, carpeting and appliance options to his clients. The business portion of his site <br />development exceeds the 200 foot setback from the front property line requirement. She said three <br />rows of pine trees are proposed to be planted to screen the commercial operation from the residential <br />portion of the property and the public road, which is in accordance with the covenants. <br /> <br />Zoning Administrator Frolik stated access will be from 149th Avenue NW and in accordance with <br />the covenants, the bituminous driveway will be developed along the common property line with Lot <br />9. She noted that the site plan indicates 2 additional future garages on the commercial section. These <br />will also have to go through site plan review when Mr. Sharp is ready to construct them. <br /> <br />Mr. Sharp stated he needs to have three separate buildings on the lot: One for his main office and <br />the other two buildings for storage and parking of equipment. He wants approval for all 3 now to <br />save on site plan review costs. Vice Chairperson Deemer inquired if it would be possible to configure <br />the buildings so they are all attached. <br /> <br />Mr. Sharp indicated he was under the impression that he could get approval for all three structures <br />during this evening's meeting and stated he had already started his home construction on the lot. He <br />said he had a problem with the required pine trees, because no other lots have pine trees. Zoning <br />Administrator Frolik advised only the cabinet maker has pine trees, and all other lots are being used <br />for residential purposes only; they do not contain a commercial use. <br /> <br />Mr. Sharp said he felt as if he were being discriminated against because he is the only one installing <br />a driveway on the common property line. Commissioner Terry stated a common driveway is <br />necessary on the west lot line due to the east side of the property being a protected wetland. Vice <br />Chairperson Deemer stated the covenants requiring a common driveway is part of the Homeowners <br />Association covenants covering the 10 lots and advised the City does not control that.
