Councilmember Look introduced the following resolution and moved for its adoption: RESOLUTION #07-01-041 RESOLUTION APPROVING THE ISSUANCE OF AN INTERIM USE PERMIT FOR OUTDOOR STORAGE IN THE E-l EMPLOYMENT DISTRICT BASED ON FINDINGS OF FACT #0788, AND DECLARING THE TERMS OF SAME. WHEREAS, RV World, Inc., hereinafter referred to as "Permittee", has properly applied to the City of Ramsey (the "City") for an interim use permit (Permit) to allow outdoor storage of RVs and/or travel trailers on the property located at 6300 Bunker Lake Blvd NW and legally described as follows: Tract C Registered Land Survey No. 30, except the west 169.41 feet thereof, together with Tract E of said Registered Land Survey, subject to easement of record, Anoka County, Minnesota. (the "Subject Property"); and WHEREAS, the Planning Commission met on January 4, 2007,' conducted a public hearing and recommended that the City Council approve the request to store RV's and/or travel trailers outdoors on the Subject Property; and WHEREAS, the City Council met on January 23, 2007 to review the request for an interim use permit to allow for outdoor storage on the SubjeCt Property. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: This permit is issued pursuant to Section 9.03.06 (Interim Use Permits) of the Ramsey City Code. The conditions of this permit are as follows: 1) The Permittee is herein allowed to store no more than forty (40) travel trailers and/or recreational vehicles (RVs) in an orderly manner in a confined area not to exceed 160 feet by 220 feet located in the southeastern portion of the Subject Property as shown on the attached exhibit. Said area shall be surfaced with either bituminous pavement or concrete no later than October 31, 2007. If not, the Permit shall become void and the Permittee shall vacate the Subject Property by October 31, 2007. 2) Upon City Council approval and prior to storing any RVs and/or travel trailers on the Subject Property, the Permittee shall provide a financial guarantee to the City in the amount of Five Thousand Dollars and no cents ($5,000.00). The purpose of the financial guarantee is to ensure timely installation of said pavement or concrete as specified in Item # 1 of this Permit. In the event the Permittee fails to install said pavement or concrete by October 31, 2007, and RVs and/or travel trailers remain on the Subject Property after said date, the Permittee herein grants the City authority to draw upon the financial surety to ensure removal of the RVs and/or travel trailers from the Subject Property.
