Motion by Chairperson Nixt, seconded by Board Member Trites Rolle, to approve the following <br />minutes as amended: <br />1) Board of Adjustment public hearing and regular meeting minutes dated December 7, 2006 <br />Motion Carried. Voting Yes: Chairperson Nixt, Board Members Trites Rolle, Cleveland, Hunt, <br />Levine, and Van Scoy. Voting No: None. Absent: Board Member Brauer. <br />PUBLIC HEARINGSBOARD BUSINESS <br />Case #1: Request for a Variance to Facilitate the Construction of a <br />Telecommunications Tower on City Property: Case of T- Mobile USA <br />Chairperson Nixt closed the regular portion of the Board of Adjustment meeting at 7:03 p.m. in <br />order to conduct the public hearing. <br />Public Hearing <br />Chairperson Nixt called the public hearing to order at 7:03 p.m. <br />Presentation <br />Chairperson Nixt indicated the request for all variances is withdrawn because of zoning <br />information provided. Staff has learned that a variance is not necessary to facilitate the <br />construction of the T- Mobile telecommunications tower. It was also determined that City Code <br />allows City Council the discretion to increase the maximum height standards by Council Action. <br />Thus, a variance is also not needed for the increase in height that the applicant is requesting. <br />Citizen Input <br />There was none. <br />Motion by Chairperson Nixt, seconded by Board Member Van Scoy, to close the public hearing. <br />Motion Carried. Voting Yes: Chairperson Nixt, Board Members Van Scoy, Cleveland, Hunt, <br />Levine, and Trites Rolle. Voting No: None.
