Motion by Commissioner LaDue, seconded by Commissioner Jensen, to recommend that City <br />Council approve the request for a Conditional Use Permit from Concrete Masonry Unlimited, Inc. <br />for an accessory warehouse use based on the Findings of Fact. <br /> <br />Motion Carded. Voting Yes: Vice Chairperson Deemer, Commissioners LaDue, Jensen, and Terry. <br />Voting No: None. Absent: Chairperson Bawden and Commissioner Wivoda. <br /> <br />Case #2: <br /> <br />Request for a Conditional Use Permit to Establish Accessory Outdoor <br />Recreational Uses to a Restaurant and Bar; Case of Diamond Sports Bar & <br />Grill, Inc. <br /> <br />Zoning Administrator Frolik explained that Diamond Sports Bar & Grill, Inc., the applicant, is <br />requesting a Conditional Use Permit to establish outdoor recreational uses including softball, <br />volleyball, and broomball as an accessory use to a restaurant and bar proposed to be developed on <br />Outlot C in Tooth Acres. She advised the City Attorney has recommended that the lighting plan for <br />ballfields be specifically defined in the Conditional Use Permit. Zoning Administrator Frolik read the <br />Findings of Fact. <br /> <br />Motion by Commissioner Jensen, seconded by Commissioner LaDue, accepting Findings of Fact # 1 - <br />15 as drafted relating to a request for a Conditional Use Permit to establish accessory outdoor <br />recreational uses to a restaurant and bar. <br /> <br />Motion Carded. Voting Yes: Vice Chairperson Deemer, Commissioners Jensen, LaDue, and Terry. <br />Voting No: None. Absent: Chairperson Bawden and Commissioner Wivoda. <br /> <br />Motion by Commissioner Terry, seconded by Commissioner LaDue, that Findings of Fact #16 <br />indicate the use will not be unduly dangerous or detrimental to a person residing or working in the <br />vicinity of the use, or to the public welfare. <br /> <br />Motion Carded. Voting Yes: Vice Chairperson Deemer, Commissioners Terry, LaDue, and Jensen. <br />Voting No: None. Absent: Chairperson Bawden and Wivoda. <br /> <br />Motion by Commissioner Jensen that Findings of Fact #17 indicate the use will substantially adversely <br />impair the use, enjoyment or market value of any surrounding property. The motion died for lack of <br />a second. <br /> <br />Motion by Commissioner LaDue, seconded by Commissioner Terry, that Findings of Fact #17 <br />indicate the use will not substantially adversely impair the use, enjoyment or market value of any <br />surrounding property. <br /> <br />Motion Carded. Voting Yes: Vice Chairperson Deemer, Commissioners LaDue and Terry. Voting <br />No: Commissioner Jensen.
