Mayor Gamec stated it should be clear to the applicant that one plan showing everything,
including architectural design and landscape design is required. He asked if this is understood by
the applicant.

Mr. Murphy responded in the affirmative.

Mayor Gamec asked if the applicant would prefer for Council to take action tonight or to have
this tabled until the first meeting in May with the required information to be provided.

Mr. Murphy replied under the circumstances as it is now it would be best to have this tabled until
the May meeting, and he will have an architectural plan to present. .

Motion by Councilmember Elvig, seconded by Councilmember Olson, to table a request for
preliminary plat and preliminary site plan review of Ebony Woods; Case of DPM Investments,
Inc., to table a request to rezone property from B-2 Business to Planned Unit Development
(PUD); Case of DPM Investments, Inc., and to table a request for Comprehensive Plan
Amendment; Case ofDPM Investments, Inc.

Further discussion: City Attorney Goodrich indicated this motion would be contingent on the
applicant waiving the time requirement. Mayor Gamec commented if the time requirement is
not waived the plans that have been presented would likely be denied. Community Development
Director Trudgeon clarified the following is being requested from the applicant: 1) a revised
preliminary plat; 2) a revised site plan showing grading, drainage, landscaping, and the location
of the actual buildings; 3) revised architectural elevations prepared by a design architect showing
materials and color of the buildings. Mr. Murphy asked if there is a particular style of the three
dormers the Council is leaning towards. Councilmember Olson replied there is not a problem
with the dormers, the suggestion is for a hip roof over the walkways. City Attorney Goodrich
advised according to Minnesota Statute 15.99, Council is required to take action on all three
cases tonight. He requested verification that the applicant is requesting the City to extend this
application for 60 days, that the applicant understands that he could in effect force the City to
take action tonight, and that he would be willing to sign what has just been stated. Mr. Murphy
responded in the affirmative. Councilmember Dehen inquired about Councilmember Elvig's
earlier comment about the dormers. Councilmember Elvig indicated he likes the variety of the
dormers with the windows, but the hip root is needed over the entryways. The hip roof is
important and a different garage door design would be an improvement.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Olson, Jeffrey, and
Strommen. Voting No: Councilmembers Dehen and Look.

Case #3:

Request to Rezone Property from B-2 Business to Planned Unit Development
(PUD); Case ofDPM Investments, Inc.

Acted on under Case No.2.

City Council / April 10, 2007
