was industrial property. After meeting with the City, he was told the property would be zoned
residential.

Community Development Director Sherman clarified that the property owner approached the City
asking if the information was submitted prior to the ordinance being in effect, if the application
would be considered. He was told that they could submit the application, however, approvals
may not be given during the period the ordinance is in effect.

Jack Menkveld, owner of property in question, stated the property is zoned industrial and
presently used as an industrial storage yard. He requested
the Planning Commission consider the site plan, regardless of approval or denial, so they may
proceed to the City Council.

Motion by Commissioner Anderson, seconded by Commissioner Jensen, to recommend that City
Council deny the proposed site plan for C.R. Concrete Design because the site is subject to the
development moratorium adopted by the City Council on August 25, 1998 and effective on
September 28, 1998.

Amendment by Acting Chairperson Deemer, seconded by Commissioner Jensen, to recommend if
City Council elects to grant an exception to the moratorium, that the site plan be returned to the
Planning Commission for review.

Amendment Carried.
