Dave Sellegren, attorney for Arcon development, Inc. - stated he read Mr. Dora's letter of <br />December 1, 1998 (Exhibit A) and found it to be basically theory. Mr. Sellegren advised that he <br />authored the statute, which Mr. Dom refers to regarding landowners' rights, and it doesn't have <br />anything to do with adjacent landowners; it has to do with people owning land. He concluded <br />"The primary standard for approving a rezoning is to make it compatible with the existing <br />Comprehensive Plan. Utilities are there and it's time to do it." Mr. Sellegren believes the statute <br />requires the rezoning and all these other things are theory. <br /> <br />Motion by Commissioner Anderson and seconded by Commissioner Jensen to include as a part <br />of the record of this public hearing attorney Dorn's December 1, 1998 letter (Exhibit A), attorney <br />Dorn's December 3, 1998 letter (Exhibit B), the Schinzel Family letter received December 3, <br />1998 (herein attached as Exhibit D), the Notice of Public Hearing (herein attached as Exhibit E), <br />and the address list of mailed notice (herein attached as Exhibit F). <br /> <br />Motion carried. Voting Yes: Chairperson Deemer, Commissioners Anderson, Jensen, Dempsey, <br />LaDue, and Wivoda. Voting No: None. Absent: Chairperson Bawden. <br /> <br />Tom Williams, 5180 157th Lane NW - declared that the Planning Commission has tabled <br />numerous requests in the last three years and questioned why they hesitate to do so when the <br />City is spending $100,000 for a new Comprehensive Plan. He stated this is not in the best <br />interests of the City, and he thinks this should be tabled. <br /> <br />Commissioner Anderson questioned whether Mr. Williams was a member of the group <br />represented by Mr. Dom, and Mr. Williams replied "not yet." <br /> <br />Curt Lugert, 15420 Ute Street NW (Lot 4, Block 2, Stanhope Terrace) - stated he just moved in, <br />and he opposes the rezoning because he bought a 2½-acre property under the assumption that the <br />adjacent land would be one-acre parcels. <br /> <br />Commissioner Anderson questioned whether Mr. Lugert was a member of the group being <br />represented by Mr. Dom, and Mr. Lugert answered he was not but he did support them. <br /> <br />Dale Holland, 15390 Ute Street NW (Lot 3, Block 2, Stanhope Terrace) - stated he built a <br />$300,000 home in an area that it was understood would be one-acre lots, adding that he was even <br />shown this on a map by the City. He declared he stands opposed to the rezoning, and that <br />although he is not a member of Mr. Dom's group, he will be joining soon. <br /> <br />John Ploeger, 15649 Juniper Ridge Drive NW (Lot 1, Block 2, Stanhope Terrace) - stated he <br />bought two lots on the promise that this area would be one-acre parcels. He added he was not a <br />member of the group represented by Mr. Dom but would be by the end of the night. <br /> <br />Jon Westrum, 15660 Juniper Ridge Drive NW - stated he attended the Comprehensive Plan <br />public hearing on December 1, and he is very much against this rezoning. He noted that the first <br />sketch plan he saw had four houses behind his lot, and the latest plan has two. He referenced one <br />of the handouts from the December 1 public hearing entitled, "What is a Comprehensive Plan?" <br />and noted the first sentence reads, "Generally, the Comprehensive Plan is a document that is an <br /> <br />Public Hearing/Planning Commission/December 3, 1998 <br /> Page 3 of 4 <br /> <br /> <br />
