Dom Law Firm, Ltd.
Wilb~ F. Dom, Jr., Attorney at Law 12301 Central Avexme Northeast, Blaine, Minnesota 55434
Telephone: (612) 754-1500 Fax: (612) 754-1044

FAX TRANSMISSION COVER SHEET

Date: December 3~ 1998

To: Mr. James Norman, City Administrator; Ms. Sylvia Frolik, Zoning
Administrator

Subject: Conformance of Zoning Ordinances to Comp l~lans

Fax Number: 42%5543

From: Dom Law Firm, Ltd.

Number of Pages including Cover Sheet: 9

Comments: Mr. Norman and Ms. Frolik:

Enclosed is a correspondence addressed to the City Council I have faxed a copy to
City Attorney Goodrich.

The gist of this correspondence is that it is my opinion that the law requiring
conformance of zoning ordinances to comp plans refers to the new plans presently
being eol~sidered; not the existing pla~t,.

While this conflicts with the opinion of Kennedy & Graven, the primary purpose of
the Kennedy & Graven opinion dealt with "automatic zoning", and the research
into the area of zoning ordinance compliance with the comp plan may have been
slightly incomplete.

I am sure that City staffwould want to do what the law requires, and that having
conflicting opinions from different attorneys does not help matters. I would hope
that you would want to have the matter reviewed by your own counsel before acting
on the Arcon re-zoning request.

Bill Dorn
