CASE #1 <br /> <br />REQUEST FOR A VARIANCE TO CONSTRUCT AN ACCESSORY STRUCTURE <br />NEARER THE FRONT PROPERTY LINE THAN THE PRINCIPAL STRUCTURE; <br />CASE OF TERRANCE AND BETTY BELSCHNER <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />City Code states that accessory structures shall not be constructed nearer the front property line <br />than the principal structure. Terrance Belschner is requesting a variance to construct a garage <br />nearer the front property line than the principal structure at 7319 162nd Lane N.W. The parcel is <br />approximately 1.9 acres in size, and the house is located approximately 90 feet from the nearest <br />point of the cul-de-sac right-of-way. Mr. Belsehner is proposing to construct a garage which will <br />be approximately 40 feet from its nearest point of the cul-de-sac right-of-way. The following <br />items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site plan <br />c) Proposed Findings of Fact <br />d) Proposed Variance <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff attempted to notify property owners within 350 feet of the <br />subject property of the request for a variance. <br /> <br />Observations: <br /> <br />The site plan submitted and an on-site inspection reveal that sharp declines in topography, <br />wetlands, mature tree growth, and alternate drainfield locations prohibit construction of a garage <br />in the side or rear yard. In Staffs opinion, the mature tree growth in the area and the alignment <br />of neighboring homes around the cul-de-sac are such that there should be no adverse impact to <br />the neighbors view of the street scape by the construction of this proposed garage. There are no <br />other garages on the Belschner property and the size of the garage proposed is well within the <br />size restrictions established by City Code for parcels under 2.0 acres in size. <br /> <br />Staff Recommendation: <br /> <br />In the opinion of City Staff, the physical features on Mr. Belschner's property justify the granting <br />of a variance and he should be entitled to have at least one garage. City Staff recommends <br />approval of the variance. <br /> <br /> <br />
