Zoning Bulletin

Denial-Township orders second mobile home removed
after discovering it uninhabitable

Homeowner claims he was not allowed to amend his appeal

Citation: Elmwood Tp. v. Miller, 2007 WL 706878 (Mich. Ct. App.
2007)

MICHIGAN (03/08/07)-Miller lived in a mobile home in Elmwood
Township. In 2003, he placed an additional mobile home on his prop-
erty, claiming that he was planning on moving into the second home.
Under the township's zoning ordinance, a property owner could place
a mobile home on his or her property if he or she intended to use it as a
residence and the dwelling met certain housing requirements. The town-
ship had to issue a homeowner a certificate of compliance before the home
could be occupied. Initially, a certificate was issued to the second home.
The township discovered, however, that the home had been stripped
of all its sinks, tubs, and plumbing, and determined that the second
home was intended to be used for storage-not a residence. The town-
ship notified Miller that he was in violation of the ordinance. Miller
contended that-precisely because the home was not a residence-he
did not have to meet the housing criteria for the home to be a legal
structu.i-e on his property.

,(;ii

i~ri~~~i{!~~~~~a~~s~~~~~~1

POSTTl!JA5TER: 5end address changes to, Zoning Bulletin, 610 Opperman Drive, P.O.
