<br />Associate Planner Dalnes explained the applicant is requesting a use that is allowed by <br />conditional use. They are working on the assumption they will have to pave some portion at the <br />Commission's discretion of where that line is. This can be a condition of the permit. <br /> <br />Mr. Burnham explained he is wondering whether the entire 2 ~ acres will need to be paved even <br />though they will not be using all of the space. A lot of the dirt would remain in the site if there is <br />pavement 150 feet out of the entrance area. He indicated a plan will be drafted to present to the <br />Commission. <br /> <br />Assistant Community Development Director Frolik advised the property is zoned E-l and rental <br />businesses are allowed with a conditional use permit. This is not a temporary use. Code <br />specifically requires a conditional use permit for a business that will sell or rent equipment or <br />vehicles. <br /> <br />Chairperson Nixt inquired about code requirements regarding outdoor storage. <br /> <br />Assistant Community Development Director Frolik indicated a surfaced area is required for <br />outdoor storage. <br /> <br />Chairperson Nixt pointed out Code discusses outdoor service, display and rental. As he <br />understands, the tenant would not be doing any of the above. <br /> <br />Assistant Community Development Frolik stated the tenant rents equipment. <br /> <br />Chairperson Nixt stated he understands why this is classified as rental, but this deals with a <br />different consumer altogether. He could see his way to grant a variance to fmd the unique <br />circumstances of the request, coupling that with a pavement and curbing plan that would deal <br />with the issues that have been raised that are intended to be met with the statute, and leaving a <br />portion of the area deemed appropriate for paving in a maintained class 5 and fencing to cut off <br />the portion of the property that is not being used for storage, so access can be maintained and <br />used in a fashion that is reliable and will comply with the intent of the ordinance. <br /> <br />Assistant Community Development Frolik stated the same can be accomplished with the <br />conditional use permit, but a better site plan is needed. <br /> <br />Chairperson Nixt indicated the area where paving would be required would likely be the area of <br />the traffic pattern and the access of the facility. He asked staff about the timeline for required <br />action. <br /> <br />Associate Planner DaInes replied the application was submitted on March 13th; action is required <br />within 120 days. <br /> <br />Chairperson Nixt infonned the applicant a much more workable site plan is required.
