<br />that at the time the property is to be developed the landowner would already be responsible for <br />wetland delineation. <br /> <br />Chairperson Nixt stated he is uncomfortable recommending the adoption of the wetland <br />functions and values map that only provides for an evaluation of roughly 1/3 of the wetlands in <br />the City. He would recommend the adoption of the wetland classification map as to those <br />specific wetlands that were field verified, and not to adopt the classification for wetlands that <br />were not field verified. He stated they may need to request an opportunity to reevaluate the <br />ordinance, but this is not the appropriate way to get to that. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Trites Rolle, to recommend that City <br />Council ratify the Municipal Wetland Management Classification Map as to only those wetlands <br />that have physically been subject to the functions and values analysis and field checked. <br /> <br />Further discussion: Chairperson Nixt stated he does not feel comfortable taking raw empirical <br />data tllat may be outdated as the basis for land use restrictions. Commissioner Hunt expressed <br />concern that a property owner would still need to spend the money to prove that a property is not <br />actually a wetland if all of the wetlands that have a number attached to them are included in this <br />approval even if they have not been delineated. Chairperson Nixt replied that is money that <br />would need to be spent regardless, as there is already delineation required as part of a <br />subdivision; however a functions and values assessment is not currently required. <br /> <br />Motion Carried. V oting Yes: Chairperson Nixt, Commissioners Trites Rolle, Brauer, Cleveland, <br />Hunt, and Levine. Voting No: None. Absent: Commissioner Brauer. <br /> <br />Chairperson Nixt indicated this will be on the agenda of the April 24, 2007 City Council <br />meeting. <br /> <br />Case #3: <br /> <br />Request for Sketch Plan Review of the Plat of Hack Center; Case of Hack <br />Real Estate Associates <br /> <br />Associate Planner Geisler indicated Case Nos. 3 and 4 will be discussed together. She stated <br />Hack Real Estat~ Associates has submitted a minor plat application along Witll their site plan <br />submittal to construct a commercial development ill Rivenwick Village, adjacent to Village <br />Bank. The sketch plan is proposing to replat Outlot A of Rivenwick Village into one buildable <br />lot, which is the same size and shape. The proposed lot meets lot requirements in the MU-PUD <br />zoning district. The total area of the lot is 9.3 acres. The plat requires some minor modifications, <br />in that some additional drainage and utility easements are required. Ms. Geisler advised the <br />sketch plan meets City Code requirements with some minor modifications, therefore staff is <br />recommending that the plat move forward in compliance with the City Staff Review Letter. <br /> <br />Case #4: <br /> <br />Request for Preliminary Site Plan Review of Hack Commercial Center; Case <br />of Hack Real Estate Associates <br /> <br />Associate Planner Geisler stated Hack Real Estate Associates has submitted a site plan and nunor <br />plat application to construct a new commercial project on Riverdale Drive adjacent to Village <br /> <br />Planning Commission/AprilS, 2007 <br />Page 14 of 22 <br /> <br />P14 <br />
