considerable discussion at the Planning Commission meeting about the design of the northeast <br />corner of the main building, just north of the intersection of 139 Lane and Jasper Street. The <br />applicant initially designed this corner with a substantial amount of glass, around a landscaped <br />plaza, in order to draw pedestrians into this corner of the site. Neighbors were concerned that the <br />amount of glass would provide too much visual access to their homes. The glass in this area has <br />been somewhat reduced. Ms. Geisler stated the third item of concern was that of access. In the <br />concept planning stage of this project, staff recommended that the applicant investigate options <br />for combining the western access with an existing access for Village Bank. The planning <br />Commission reinforced this staff recommendation. The applicant had some preliminary <br />discussions with the bank, and drew up some alternative access arrangements. Given the size of <br />the subject property and traffic conflicts between the two sites if the access is combined, a shared <br />access does not seem feasible, and staff is no longer recommending it. <br />Associate Planner Geisler stated the Planning Commission recommended approval of the <br />preliminary site plan, with contingencies related to the loading dock, architectural design, and <br />access issues. Staff believes the revisions largely address these concerns, and recommends <br />approval of the preliminary site plan contingent upon compliance with the City Staff Review <br />Letter dated March 30, 2007, revised April 19, 2007. Ms. Geisler indicated a petition and letter <br />were distributed to the Council prior to this meeting. <br />Acting Mayor Elvig stated the City has received a petition from residents in this area. He <br />informed the residents although this is not a public hearing he will be allowing input for a limited <br />time. There was a lengthy Planning Commission meeting with the video and minutes available <br />for the Council to review. He commented the residents have done a good job in their discussions <br />with the developer. <br />Councilmember Jeffrey commented he was in favor of the developer working out a shared access <br />with the bank. He likes that the loading dock was moved to the south, but there is still a service <br />access off of 139 Lane. <br />Mr. Marty Klain, Hack Real Estate, replied there is an access point, but the entire service area is <br />being enclosed. <br />Councilmember Jeffrey asked if there will be garbage trucks accessing this area at 5:00 a.m. next <br />to the residential area. <br />Mr. Klain replied the garbage trucks will come to this area, but it will not be -at 5:00 a.m.; pick up <br />can be at the end of the day or midday. He stated garbage is disposed out of these stores daily <br />and the access is needed. They will be very sympathetic to the fact that this is a residential area, <br />but with the maintenance and snow removal equipment everything cannot be accessed from the <br />retail part of the store. <br />Councilmember Jeffrey inquired about the retailers there have been discussions with. <br />Mr. Klain replied at this time most of the retailers they have gone to are waiting for approval to <br />be granted from this Board.
