Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION #07- 05 -XXX <br />A RESOLUTION RESCINDING RESOLUTION 407 -04 -098 AND ADOPTING THIS <br />RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS FROM THE ' COUNCIL <br />CONTINGENCY FUND TO THE POLICE BUDGET OF PROFESSIONAL SERVICES <br />TO COVER THE COST OF CLEAN -UP OF HAZARDOUS MATERIALS. <br />WHEREAS, on March 25, 2007, the Ramsey Police Department responded to a call of <br />the remnants of a methamphetamine lab "dumped'' at the 15100 block of Puma Street in the City <br />of Ramsey; and <br />WHEREAS, officers located what was found to be "Hazardous Materials" that had been <br />discarded by unknown persons; and <br />WHEREAS, West Central Environmental Consultants responded to the scene to gather <br />up the materials for safe disposal; and <br />WHEREAS, the property owner was not responsible for the materials and assessing the <br />cost of clean-up back to property owners such as this would discourage the reporting of dumped <br />hazardous materials; putting themselves and others at risk; and <br />WHEREAS, on April 10, 2007, Council adopted Resolution #07 -04 -098 authorizing the <br />transfer of funds from the Council Contingency Fund to pay for professional services (WCEC) to <br />• clean up the hazardous materials; and <br />WHEREAS, the initial invoice received from WCEC was for $3,163.78 which billed <br />their time at 1.5X and it should have been billed at Double Time; and <br />WHEREAS, the difference is $342, for a total of $3,505.78; and <br />WHEREAS, Council is asked to authorize the amount of $3,505.78 be transferred from <br />the Council Contingency Fund to the Police Budget of Professional Services to cover the cost of <br />clean-up of the meth lab site at the 15100 block of Puma Street in the City of Ramsey. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) That the Council approves the City fund the clean-up of the meth lab dump. <br />2) That the Council rescinds Resolution #07 -04 -098 authorizing a previous amount for <br />clean up. <br />3) That the amount of $3,505.78 be transferred from the Council Contingency Fund to <br />the Police Budget of Professional Services to pay Invoice 954356 from West Central <br />Environmental Services for clean-up of the clandestine meth lab materials. <br />• The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />, and upon vote being taken thereon, the following voted in favor thereof: <br />and the following voted against the same: <br />—65— <br />
