Staff has not done a real estate analysis and does <br />not have the expertise to do that. <br /> <br />Acting Mayor Elvig explained the pirating of customers is a concern, and the City could not be <br />more concerned about that than anyone with what has been put into Town Center. Until the <br />ownership at Town Center is resolved it will be difficult for it to grow and prosper. However, <br />that does not give any right that free commerce cannot be achieve.d elsewhere in the City. These <br />property owners have the right to sell their property and the developer has the right to compete in <br />the City. The Council is not a governing board to be able to direct commerce. <br /> <br />Councilmember Dehen asked if the impact to Jasper Street and 139th Lane has been considered, <br />and whether commercial traffic would cause premature deterioration on the roads. <br /> <br />Public Works Director Olson indicated Riverdale Drive is constructed to state aid standards at 10 <br />tons per axle. Jasper Street and 139th Lane are constructed for 7 tons per axle. He explained <br />residential roads are built to withstand garbage trucks hauling in and out, so there will not <br />necessarily be an issue from garbage trucks. Jasper Street and 139th Lane are designed to <br />accommodate semi truck traffic, but not to the extent that Riverdale Drive would be. <br /> <br />Councilmember Jeffrey pointed out there is a commercial access on 139th Lane and Jasper Street <br />for the dumpsters. Those services are typically accessed from the site, not from a residential <br />street, and there is not a fire road included in the plan around the building. He requested input <br />from the Fire Chief. <br /> <br />Fire Chief Kapler indicated the requirement is for an improved surface within 150 feet of any <br />part of the building; the parking lot in this plan counts for that 150 feet. . Staff has reviewed this <br />from a fire access standpoint and it meets the fire code requirements. <br /> <br />Acting Mayor Elvig stated there are a lot of things that he likes about the plan being presented, <br />and a lot of this could not have happened without the citizen input. He is not keen about the <br />back door entry and the traffic, but he understands there will be limited traffic along that back <br />corridor. It was planned that there would be a lot of traffic on Rivenwick Drive. This has an <br />amenity to the neighborhood with the pedestrian access to the retail space nearby. The Holiday <br />Station store is also going in down the street for the neighborhood to use as well. Regarding the <br />vehicle traffic and townhomes up against a retail operation, he is sympathetic that the residents <br />did not know about it or were told something different. If they are able to keep the commercial <br />traffic on 139th Lane and Jasper Street limited to a garbage truck it would be no different than <br />what would typically go down a residential street. He suggested language be added to state that <br />garbage pickup would be during normal business hours. He stated he would also agree with a <br />sign posted to restrict the parking to residential parking. He inquired about the ability to build <br />the road up to prevent the roads from being degraded from the truck traffic. <br /> <br />Public Works Director Olson indicated the roads could be repaved, although he does not believe <br />they would erode prematurely.
