Councilmember <br />Jeffrey replied he would need to see a drawing that shows this. Acting Mayor Elvig indicated it <br />could be included as a contingency of the approval. Councilmember Jeffrey stated any access <br />from Jasper Street and 139th Lane would need to be eliminated. Mr. Klain asked if a regular <br />door could be included for access rather than the overhead door. He noted there is currently a <br />curb cut in this location. Councilmember Jeffrey replied an egress will likely be needed, but he <br />does not want any maintenance vehicles using the residential street. Mr. Klain asked if snow <br />removal equipment would be amenable in this area if there are no dumpsters. Acting Mayor <br />Elvig requested clarification that Councilmember Jeffrey's opposition is to commercial traffic Qn <br />that road. He noted if there is not a garage door in this location it will not promote commercial <br />traffic. Councilmember Jeffrey stated there should also not be any commercial vehicles parked <br />behind the building to access it. He could agree to a regular door for egress, but he does not <br />want any maintenance vehicles using the access. <br /> <br />City Attorney Goodrich suggested the following addition to the motion if Council would like to <br />vote on the preliminary site plan: contingent on no commercial access or traffic onto 139th Lane <br />or Jasper Street, and that no commercial vehicles be parked on the residential streets of Jasper <br />Street and/or 139th Lane. <br /> <br />Councilmember Jeffrey stressed that there should not be any mechanical vehicles that are <br />working for, working with, or doing maintenance on this particular shopping center parking in <br />front of these houses. <br /> <br />Motion by Councilmember Olson, seconded by Councilmember Strommen, to approve the <br />preliminary site plan for the Hack Center, contingent on the following: compliance with the City <br />Staff Review Letter dated March 30,2007, revised April 19, 2007; compliance with the MnDOT <br />Staff Review Letter, berming to be included as feasible, no commercial access or traffic onto <br />139th Lane or Jasper Street, and no commercial vehicles related to Hack Center to be parked on <br />the residential streets of Jasper Street and/or 139th Lane. <br /> <br />Further discussion: Councilmember Look stated it is important that they do not have that traffic <br />on 139th. He has a couple of young kids and understands the concern. He also understands this <br />is zoned commercial property, and there is a possible legal issue in the City denying this without <br />a good reason. Also, with the location on Highway 10 there will be a need for this type of <br />product within the City. In light of the redirection of traffic on 139th Lane and Jasper Street he <br />will be in support of this motion. Councilmember Strommen indicated she does not understand <br />how it would be distinguished whether a vehicle is a service vehicle that might be pulling up to <br />the townhomes versus one that might be servicing Hack Center. Mr. Lindberg stated vehicles <br />there to service townhomes would most likely be parked on the residential side of the street. The <br />only exception to that rule is the landscaping crew and plowing hired by the association and they <br />are usually parked further down. Councilmember Strommen indicated she is not opposed to this <br />provision, but there is a practical side to that. <br /> <br />Motion carried. Voting Yes: Acting Mayor Elvig, Councilmembers Olson, Strommen, Dehen, <br />Jeffrey, and Look. Voting No: None.
