adjacent to the sidewalk along 153rd Lane. The applicant has also reduced the slopes surrounding the wetland. Staff is again recommending that the split rail fence be replaced with a steel fence to provide for further safety measures along the wetland. The Planning Commission discussed the need to provide for a public access easement from the town_home units to the .5 acre open space node located at the southeastern corner of the plat in order for the subject open space node to be counted towards common open space requirements. The developer is willing to provide an access easement from the town_house units to the open space node if the City Council desires. The developer would like to discuss a few other options to provide an access to this area with the City Council, however they are willing to provide the necessary access if directed by the City Council. Recommendation: The Planning Cornmission recommended preliminary plat approval subject to compliance with the City Staff Review Letter dated May 16, 2003, revised June 6, 2003, the developer providing appropriate landscaping along the pond located at the northwest corner of Alpine Drive and Sodium Street, installing safety features along the wetland located at the northeast corner of Sodium Street and Sunfish Lake Blvd., and providing for a public access easement from the townhome units to the .5 acre open space node located at the southeastern corner of Alpine Drive and Nowthen Blvd. As referenced in their June 6, 2003 letter, it appears that the Developer has addressed all of the Planning Commission's concerns and will provide a revised preliminary plat to staff and address staffs recommendations regarding the type of fence provided around the pond and wetlands, prior to the City Council meeting on June 10, 2003 As you may be aware there is a resolution attached to this case requesting that the City Council waive the 14 day time frame requirement between the Planning Commission public hearing and City Council review. It should be noted that the developer paid the applicable fee to request that the Planning Commission hold a special meeting to discuss the preliminary plat of Alpine Acres. The Planning Commission scheduled a special meeting for May 20, 2003. Due to a lack of quorum, the Planning Commission was unable to take official action on the preliminary plat on May 20, 2003. Due to scheduling conflicts the Planning Commission was unable to hold a meeting prior to their regular June 5, 2003 meeting. City Code states that preliminary plats cannot be reviewed by the City Council until at least 14 days after the Planning Commission holds a public hearing. Due to the absence of a quorum at the special May 20, 2003 Planning Commission meeting, the developer is requesting that the City Council waive the 14 day time frame requirement to allow the City Council to review the preliminary plat of Alpine Acres at their June 10, 2003 meeting.
