Community Development Director Frolik noted that the surrounding properties were notified, but <br />no public comment has been received. <br /> <br />Mr. Richmond stated that when he applied for the permit he went around to all the neighbors <br />informing them of what he was doing. He explained that the case before the City Council states <br />conditional use permit, but all he was asking for was a variance. At the time he purchased the <br />property he was under the understanding that the City had a two-acre minimum on lot sizes and <br />on a two-acre lot, an accessory structure can be up to 2,064 square feet. He is proposing to have <br />2,064 in accessory buildings. In working with staff on the issue they pulled a plat map that <br />included a note indicating that his lot was 1.94 acres, which is the reason all this was taking <br />place. He stated that he thought he was doing everything correctly when he proceeded with the <br />project. <br /> <br />Mayor Gamec inquired as to the reason for requiring the conditional use permit over a variance. <br /> <br />Community Development Director Frolik explained that a variance is for dimensional issues only <br />when they can't meet setbacks and have to prove a hardship. As staff amends Chapter 9 of City <br />Code they are going to include a provision in the variance language for practical difficulty. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Kurak, to adopt Resolution #03- <br />05-109 adopting Findings of Fact #0647 relating to Daryl and Carol Richmond's request for a <br />conditional use permit to exceed accessory structure size restrictions on the property at 17623 <br />Marmoset Street NW. <br /> <br />Further discussion: Councilmember Zimmerman inquired if the lot size is calculated by not <br />including the right of way. Community Development Director Frolik replied yes. <br />Councilmember Elvig complimented Mr. Richmond for discussing the project with his neighbors <br />prior to proceeding forward. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Cook, Kurak, Elvig, Pearson, <br />Strommen, and Zimmerman. Voting No: None. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Kurak, to approve Daryl and <br />Carol Richmond's request to exceed accessory structure size restrictions based on Findings of <br />Fact #0647 and adopt Resolution #03-05-110 declaring terms of same. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Cook, Kurak, Elvig, Pearson, <br />Strommen, and Zimmerman. Voting No: None. <br /> <br />Case #10: Order 2003 Street Maintenance Program <br /> <br />City Engineer Jankowski stated that the 2003 Pavement Maintenance Program consists of (a) five <br />projects, which consist of cracksealing and sealcoating of City streets (b) two projects, which <br />involve a one and one-half inch bituminous overlay of City streets, and (c) a one-inch overlay of <br />bituminous trails in Emerald Pond Park. <br /> <br />City Council/May 13, 2003 <br />Page 16 of 29 <br /> <br /> <br />
