CASE # <br /> <br /> REQUEST TO REZONE CERTAIN PROPERTY <br />FROM B-1 BUSINESS TO R-2 MEDIUM DENSITY RESIDENTIAL; <br />CASE OF TURTLE MOON INC. <br /> By: Megan Wald, Associate Planner <br /> <br />Background: <br /> <br />Turtle Moon Inc. is requesting the City rezone a portion of the proposed Rivenwick 3~a Addition <br />from B- 1 Business to R-2 Medium Density Residential. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />Site location map <br />Site Plan <br />Planning Commission meeting minutes dated October 10, 2002 <br />Proposed Findings of Fact <br />Proposed Ordinance <br /> <br />Notification: <br /> <br />State statute requires notification of the public heating to owners of property within 350 feet of <br />the subject property. Staff notified-property owners within 700 feet of the subject property of the <br />request for rezoning. <br /> <br />Observations: <br /> <br />The applicant is proposing to develop 112 townhouse units on approximately 19 acres located <br />north of the existing R_ivenwick residential development. The project area is zoned a <br />combination of R-2 Medium Residential and B-1 Business. <br /> <br />The proposed Rivenwick 3~a Addition contains Outlot D and Outlot E, which are. platted lots that <br />were anticipated to serve as the future alignment of Riverdale Drive when the area developed. <br />Due to the configuration of the proposed townhouse development, Riverdale Drive has been <br />shifted to' the north ranging from 40 feet to 90 feet. The total area to be rezoned is approximately <br />1.82 acres in size. <br /> <br />Property located south of the platted outlots (Outlot D and E) is 'zoned R-2 Medium Density <br />Residential and north of the platted outlots is zoned B-1 Business. The Comprehensive Plan <br />designates the area. south of the proposed 'Riverdale Drive as .medium density residential <br />development and north of the outlots is designated as Mixed-Use development; The proposed <br />rezoning is consistent with the Comprehensive Plan as-the ComPrehensive Plan. permits higher <br />density developments to occur in a mixed-use designation. <br /> <br />-163- <br /> <br /> <br />
