I <br /> I <br />,I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> ! <br /> I <br /> I <br /> I <br /> i <br /> I <br /> ! <br /> I <br /> I <br /> <br />acquire fee and easement interests in certain State-owned lands adjacent to its Sunwood Drive <br />right-of-way to enable construction of the public street extensions; and <br /> <br /> WHEREAS, the City initiated the action captioned above to condemn the lands described <br />on the attached Exhibit A (the "Premises") which it deemed necessary for the public street <br />extensions; and <br /> <br /> WHEREAS, the State consented to the City's condemnation; and <br /> <br /> WHEREAS, the Premises are a portion of the lands commonly identified as the <br />Anoka/Ramsey Closed Landfill (the "Landfill") for which the State has assumed various <br />responsibilities, including responsibilities for environmental response actions, under the <br />authority of the Landfill Cleanup Program, Minn. Stat. § 1,15B.39 et seq., and that Agreement <br />entitled "Landfill Cleanup Agreement Between Waste Management of Minnesota, Inc. and the <br />Commissioner of the Minnesota Pollution Control Agency Pursuant to Minn. Stat. §§ 115B.39- <br />115B.46," recorded with the Anoka County Recorder on March 11, 1998, as document no. <br />1326786; and <br /> <br /> WHEREAS, the State, as part of its environmental response actions, is treating the <br />groundwater beneath the Landfill which involves, in part, a State-owned water treatment <br />building, a State-owned sanitary sewer line, and a State-owned water discharge line (the "utility <br />lines"), which utility lines serve the water treatment building; and <br /> <br /> WHEREAS, the Sunwood Drive ROW proceeds generally west-to-east, bisects lands <br />owned by the State at the Landfill, and is located between that part of the Landfill where waste <br />was deposited (which is north of the Sunwood Drive ROW) and the State's water treatment <br />building (which is south of the Sunwood Drive ROW); and <br /> <br />-211- <br /> <br /> <br />
