THE PURPOSE AND INTENT OF THIS EASEMENT IS TO: <br /> <br />-220- <br /> <br /> Grant a fight-of-way for Grantor's existing underground sanitary sewer and water <br />discharge utility lines. Grantee may lay, construct, operate, inspect, maintain, repair, replace, <br />substitute, relocate, and remove said underground utility lines and, if practical and lawful, may <br />install additional utility lines within the right-of-way granted including, but not limited to, water, <br />sewer, gas,. telephone, electric, and cable, and shall have the right of ingress and egress in, on, <br />over, and through the above-described land for any and all purposes necessary or convenient to <br />the exercise by Grantee of the rights and easements granted herein. <br /> <br /> FURTHER COVENANTING, GRANTOR AND GRANTEE, FOR THEMSELVES, <br />THEIR SUCCESSORS AND ASSIGNS: <br /> <br /> 1. Grantor releases the Grantee, its successors and assignS, from all claims for any <br />and all damages to the lands through and across which the land granted is located, by reason of <br />the Easement herein conveyed. <br /> <br /> 2'. Grantor and Grantee agree that Grantor shall have the right to fully use and enjoy <br />the Premises except for such use as may unreasonably interfere with the exercise by Grantee of <br />the rights granted in this Easement. Grantee acknowledges that the surface of the Premises is <br />presently occupied by the City's street (Sunwood Drive). In the event Grantee's exercise of <br />rights granted by this Easement damages Sunwood Drive, Grantee agrees to repair the damages <br />to Sunwood Drive and restore the damaged portion of Sunwood Drive to a condition at least <br />equal to its condition prior to Grantee's exercise of rights. <br /> <br /> 3.
