THE PURPOSE AND INTENT OF THIS EASEMENT IS TO: -220- Grant a fight-of-way for Grantor's existing underground sanitary sewer and water discharge utility lines. Grantee may lay, construct, operate, inspect, maintain, repair, replace, substitute, relocate, and remove said underground utility lines and, if practical and lawful, may install additional utility lines within the right-of-way granted including, but not limited to, water, sewer, gas,. telephone, electric, and cable, and shall have the right of ingress and egress in, on, over, and through the above-described land for any and all purposes necessary or convenient to the exercise by Grantee of the rights and easements granted herein. FURTHER COVENANTING, GRANTOR AND GRANTEE, FOR THEMSELVES, THEIR SUCCESSORS AND ASSIGNS: 1. Grantor releases the Grantee, its successors and assignS, from all claims for any and all damages to the lands through and across which the land granted is located, by reason of the Easement herein conveyed. 2'. Grantor and Grantee agree that Grantor shall have the right to fully use and enjoy the Premises except for such use as may unreasonably interfere with the exercise by Grantee of the rights granted in this Easement. Grantee acknowledges that the surface of the Premises is presently occupied by the City's street (Sunwood Drive). In the event Grantee's exercise of rights granted by this Easement damages Sunwood Drive, Grantee agrees to repair the damages to Sunwood Drive and restore the damaged portion of Sunwood Drive to a condition at least equal to its condition prior to Grantee's exercise of rights. 3. The rights and easements granted herein shall be assignable together or separately and in whole or part. TO HAVE AND TO HOLD THE SAME, to the State, its successors and assigns, Forever.
