I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br />:1 <br /> I <br /> I <br /> I <br /> i <br /> I <br /> <br />SETTLEMENT OF EBERT CONSTRUCTION/SEH <br /> FIRE STATION II CLAIMS <br /> <br />By: William IL Goodrich, City Attorney <br /> <br />Background: <br /> <br />In September, 2002 the City Council approved an agreement with Short Elliot Hendrickson <br />("SEH") architects of the Fire Station 1I project. The settlement provided-that the City would pay its <br />outstanding bill with SEH in return for SEH indemnifying the City fi:om any further claims by Ebert <br />Construction, the general contractor of the project. SEH and Ebert have now agreed to settle <br />Ebert's outstanding claim by SEH paying Ebert $8,000.00 on behalf of the City. As stated above, <br />there is NO cost to the City as a result of this settlement. <br /> <br />Enclosure: <br /> <br />Release and Settlement Agreement <br /> <br />Recommendation: <br /> <br />Staff recommends authorizing the Release and Settlement Agreement. <br /> <br />Council Action: <br /> <br />Motion to authorize the Mayor and City Administrator, on behalf of the City, to execute the Release <br />and Settlement Agreement between Ebert Construction, Short Elliot Hendrickson, Inc. and the City. <br /> <br />Review Checklist: <br /> <br />City Administrator <br />Public Works Director <br /> <br />-223- <br /> <br /> <br />
