I l i PEDESTRIAN/BICYCLIST PATHWAY EASEMENT AGREEMENT This Agreement is made and entered into as of the day of by North Suburban Management, LLC, a Minnesota Limited LiabilitY corPoration (the "Owners"), and the City of Ramsey, a municipal corPoration of the State of Minnesota (the "City"). RECITALS The Owners are the fee title owners of a certain ParCel of real property situated in the City of Ramsey, County of Anoka, State of Minnesota, being legally described as Lot 1, Block 2, A.E.C. ENERGY PARK, Anoka County, Minnesota, according to the recorded plat thereof (the "Parcel"). The City is desirous of receiving an easement hcross the Parcel for general public use as a pedestrian and bicyclist pathway, and Owner(s) are willing to grant such easement, Accordingly, in consideration of the foregoing premises and agreement herein contained, it is hereby agreed by and among the parties hereto as follows: 1. Definitions: Each reference in this Agreement to any of the following terms shall mean: 1.1 "Easement Area" · A 15.00 foot easement for trail purPoses over, under and across Lot 1, Block 2, A.E.C. ENERGY PARK, the centerline of which is described as follOws: Commencing at the Northwest comer of said Lot 1; thence South 00 degrees 33 minutes 06 seconds West assumed bearing, along the West line of said Lot 1, a distance of' 25139 feet to the actual point of beginning of the centerline to be described: thence North 80 degrees 50 minutes 50 seconds East a distance of 53.45; thence North 75 degrees 14 minutes 34 seconds East, a distance of 50.50 feet, more or less, to the North line of said LOT 1, and said centerline there terminating. 1.2 "Pathway" An eight foot (8') wide bituminous surfaced pedestrian/bicyclist pathway for public use to be constructed within the Easement Area. Pathway Easement. Owner(s) hereby grant, bargain, .conveY and quit claim unto the City, a perPetual easement for public use over, on and across the Easement Area, for the purPose of utilizing the same for the Pathway. ' o Riffhts and Obligations of CitY. The City'shall have the following rights and obligations: 3.1 The City shall have the right to enter upon the Easement Area for the purPose of maintaining, repairing or imprOving the Pathway.
