I <br /> <br />l <br />i <br /> <br />PEDESTRIAN/BICYCLIST PATHWAY EASEMENT AGREEMENT <br /> <br />This Agreement is made and entered into as of the day of <br />by North Suburban Management, LLC, a Minnesota Limited LiabilitY corPoration (the <br />"Owners"), and the City of Ramsey, a municipal corPoration of the State of Minnesota <br />(the "City"). <br /> <br />RECITALS <br /> <br />The Owners are the fee title owners of a certain ParCel of real property situated in the <br />City of Ramsey, County of Anoka, State of Minnesota, being legally described as Lot 1, <br />Block 2, A.E.C. ENERGY PARK, Anoka County, Minnesota, according to the recorded <br />plat thereof (the "Parcel"). <br /> <br />The City is desirous of receiving an easement hcross the Parcel for general public use as a <br />pedestrian and bicyclist pathway, and Owner(s) are willing to grant such easement, <br /> <br />Accordingly, in consideration of the foregoing premises and agreement herein contained, <br />it is hereby agreed by and among the parties hereto as follows: <br /> <br />1. Definitions: Each reference in this Agreement to any of the following terms <br /> shall mean: <br /> <br />1.1 <br /> <br />"Easement Area" · A 15.00 foot easement for trail purPoses over, under <br />and across Lot 1, Block 2, A.E.C. ENERGY PARK, the centerline of <br />which is described as follOws: <br /> <br />Commencing at the Northwest comer of said Lot 1; thence South 00 <br />degrees 33 minutes 06 seconds West assumed bearing, along the West line <br />of said Lot 1, a distance of' 25139 feet to the actual point of beginning of <br />the centerline to be described: thence North 80 degrees 50 minutes 50 <br />seconds East a distance of 53.45; thence North 75 degrees 14 minutes 34 <br />seconds East, a distance of 50.50 feet, more or less, to the North line of <br />said LOT 1, and said centerline there terminating. <br /> <br />1.2 <br /> <br />"Pathway" An eight foot (8') wide bituminous surfaced <br />pedestrian/bicyclist pathway for public use to be constructed within the <br />Easement Area. <br /> <br />Pathway Easement. Owner(s) hereby grant, bargain, .conveY and quit claim unto <br />the City, a perPetual easement for public use over, on and across the Easement <br />Area, for the purPose of utilizing the same for the Pathway. ' <br /> <br />o <br /> <br />Riffhts and Obligations of CitY.
