Council member introduced the following resolution and moved for its adoption: RESOLUTION #03-02- RESOLUTION AUTHORIZING THE PREPARATION OF A FEASIBILITY STUDY WHEREAS, OAKWOOD LAND DEVELOPMENT, INC., RAMSEY sHOOTING CENTER, LLC and JOHN ROWE, ("LANDOWNERS") have petitioned the CITY OF RAMSEY ("CITY") for the extension of' urban services to certain areas of the CITY identified on the attached map ("Subject Areas"); and WHEREAS, the CITY'S Comprehensive Plan identifies the Subject Areas proposed by the LANDOWNERS to be served with municipal utilities as "Rural Developing" and "Central Reserve Area"; and WHEREAS, the CITY'S Comprehensive Plan declares that the extension of urban services to its land areas designated "Rural Developing" and "Central Reserve Area" is not practical or financially feasib!'e; and WHEREAS, notwithstanding the cITy's Comprehensive Plan designation of the Subject Areas with urban services, the LANDOWNERS request that the CITY authorize a Feasibility Study t0 determine the feasibility of serving the Subject Areas with urban services; and . WHEREAS, the CITY has significant reservations with the LANDOWNERS.' proposal for extension of urban services to the SUbject Areas; and WHEREAS, notwithstanding the CITY'S significant reservation the LANDOWNERS continue torequest that the CITY authorize a Feasibility Study. NOW THEREFORE, BE IT RESOLVED BY THE CITY 'COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That the CITY authorizes the engineering firm of Bolten & Menk to prepare a Feasibility Study to determine the feasibility of the CITY extending urban services to the Subject Area contingent upon the following conditions: a) b) c) That the LANDOWNERS pay all expenses of Bolten & Menk in preparing the Feasibility Study. That prior to the CITY directing Bolten & Menk to perform the Feasibility Study, the LANDOWNERS shall deposit with the CITY the sum of $14,050.00 cash which amount is. 125% of estimated cost of the Feasibility. Study (the "Escrow Account"). In additon, the Landowner shall agree to reimburse the City for its adm/nistrative expenses in overseeing the preparation of the feasibility study. The terms of the Escrow Account shall permit the CITY to draw upon it to pay all City administrative expenses and including Bolten & Menk's fees for the preparation of the Feasibility Study. From the Escrow Account any funds not necessary for payment of the Feasibility Study shall be returned to Landowners within:60 days of the City's receipt of the completed Feasibility Study. -214- RESOLUTION # 03-02- Page 1 of 2 I I I !
