Principal City Engineer Olson replied that there was a lot of water in the wetland to begin with,
but he does not claim that it would never have happened.. He explained that the difficulty with
dewatering is that the permit comes from the DNR and the City does not have much say over it.

Councilmember Hendriksen stated that if the City does not have any regulations that limit where
a developer can pump water then there seems to be a problem.

Principal City Engineer Olson replied that the City did stop the dewatering a number of times
because of concerns.

Councilmember Hendriksen stated that if there is nothing in the ordinance that states the City has
to be consulted about dewatering activities there is a problem.

Principal City Engineer Olson replied that the City require that the developer receive all the
necessary permits.

Councilmember Hendriksen replied that that apparently is not sufficient.

Principal City Engineer Olson stated that the permit is issued by the DNR and the City has no
part of it. ~

Mayor Gamec stated that this was a very unique situation because one of the pipes was plugged.
Once the pipe was opened the water began moving and the water levels went down right away.
The swamp is so covered with brush that it should probably be cleaned out for the water to flow
better.

Principal City Engineer Olson requested authorization for an additional $1,000 for the wetland
delineation.

Councilmember Hendriksen stated that he did not think that developers should be assuming that
they can come along and discharge water into a Class I wetland and have standing water sit there
without having some sort of review occur with the City that makes sure it is not going to cause
substantial financial loss. He felt that there should be some kind of review by the City to assure
that the City will look at where the water is going to be discharged.

Councilmember Zimmerman stated that he was not sure that the additional easements, were
necessary.

Principal City Engineer Olson explained that none of the residents have asked for the easements,
but the City has spent a lot of time determining what the water levels would be during a 100 year
event and want to make sure they acquire the property they are using.

Councilmember Zimmerman inquired in the future if this happens should it be the City's
responsibility to purchase the easements of the developers.

Public Works Committee/November 19, 2002

-30-
