CASE # <br /> <br /> REQUEST FOR AN INTERIM USE PERMIT TO ALLOW <br />OUTDOOR STORAGE OF COMMERCIAL VEHICLES AND EQUIPMENT ON A <br />RESIDENTIALLY ZONED PARCEL; <br /> CASE OF GERALD BAUER <br /> By: Megan Wald, Associate Planner <br /> <br />Background: <br /> <br />The City received a complaint in November of 2002, reporting that Able Paving & Construction was <br />storing their commercial vehicles and equipment and possibly operating a branch office on the <br />property located at 16130 Variolite Street, also known as the St. Anthony Gun Club property: <br /> <br />Gerry Bauer is the owner of the subject property, which is now called Ramsey Shooting Center. Staff <br />contacted Mr. Bauer on November 14, 2002 stating that the Ramsey Shooting Center is a legal non- <br />conforming use, however additional commercial activity on the subject property would be a violation <br />of City Code. <br /> <br />Mr. Bauer contacted City Staff and stated he is leasing a portion of the subject property to Able <br />Paving & Construction, who is utilizing the property for outside storage of their commercial vehicles <br />and equipment. Mr. Bauer is requesting an interim use permit to allow for outside storage of <br />commercial vehicles and equipment on the subject property for approximately a 2-year period. <br /> <br />The following items are enclosed for your review: <br /> <br />a) Site location map <br />b) Pictures of the Subject Property <br />c) Letter sent to the applicant dated November 14, 2002 <br />d) Letter from James Couch dated February 1, 2003 <br />e) Email from Sharon Stuckmayer dated February 6, 2003 <br />f) Email from Sue Foell dated February 12, 2003 <br />g) Draft Planning Commission meeting minutes dated February 6, 2003 <br />h) Proposed Findings of Fact <br />i) Proposed Interim Use Permit <br /> <br />Notification: <br /> <br />In accordance with State statute, Staff notified property owners within 350 feet of the subject <br />property of the public hearing. <br /> <br />Observations: <br /> <br />The subject property is zoned R-1 Residential and City Code does not permit commercial activities <br />as a principal use in a residential district. As previously stated, the gun club is a legal non- <br /> <br />-113- <br /> <br /> <br />
