Absent: Councilmember Cook. <br /> <br />COUNCIL BUSINESS <br /> <br />Case #1: <br /> <br />Adopt Ordinance to Amend Setback and Height ReqUirements for Detached <br />Accessory Buildings or Garages .... <br /> <br />Community Development Director Frolik stated that on .January 14, 2003, the City Council <br />introduced an ordinance to amend the setback and height requirements for detached accessory <br />buildings or garages. The significant changes to the ordinance are as follows: <br /> <br />ao <br /> <br />On parcels 2 acres and greater in size, the accessory building can'be located closer <br />to the front property line than the home as long as it maintains compliance with <br />the standard front yard setback, is constructed with the same materials as the <br />home, and is designed with soffit, fascia and eave overhang like the home. <br /> <br />bo <br /> <br />The height of an accessory building will be regulated by lot size versus whether <br />the property is in or out of the Metropolitan Urban Service Area. Variance criteria <br />was also established to vary from the height restriCtions. <br /> <br />When the accessory building is within 5 feet of the principal building,, adding in <br />the option to Construct the accessory bUilding. with a 1-hour fire rated wall instead <br />of requiring it to be attached to the principal building. <br /> <br />Eliminating the requirement that states accessory buildings within i0 feet of the principal <br />building must comply with the same setback requirements as the principal building. <br /> <br />Motion by Councilmember Kurak, seconded by CoUncilmember Pearson, to adopt Ordinance <br />#03-01 to amend the setbacks and heights for accessory buildings. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Councilmember Kurak aye <br />Councilmember Zimmerman aye <br />Councilmember Cook absent <br />Councilmember Pearson aye <br /> <br />City Council/January 28, 2003 <br /> Page 5 of 16 <br /> <br />-21- <br /> <br /> <br />
