The City Council has enacted a trail development fee in the <br />amount of Four Hundred Seventy Five Dollars and no cents ($475.00) per unit. Therefore, a <br />payment in the amount of Fifty Three Thousand Two Htmdred Dollars and no cents <br />($53,200.00) (112 lots x $475/Iot) shall be paid to the CITY prior to releasing the Plat for <br />recording. The DEVELOPER shall also be responsible for constructing an eight (8).foot' <br />wide bituminous running parallel to Riverdale Drive from County Road #56 and connecting <br />to Riverdale ?ark located east of said.Plat. The DEVELOPER shall provide the CITY with <br />a separate easement, in recordable form, for trail purposes to accommodate said trail. The <br />cost associated with said trail are not eligible.as a credit towards the Trail Development Fees' <br />and/or Park Dedication except for that portion of the trail located outside of the Plat that is <br />upon the existing Riverdale Park. <br /> <br />Sidewalk Construction. The DEVELOPER shall construct and pave, in accordance with <br />CITY standards, a five (5) foot wide concrete sidewalk with pedestrian ramps in locations <br />prescribed by the CITY, not to exceed 5% in grade, along the so.uth side of 139th Avenue. <br />The costs associated with sidewalk construction are not eligible as a credit towards the Trail <br />Development Fees and/or Park Dedication requirements due on the Plat. . <br /> <br />Tree, Shrub and Sod Planting Plan. The addition of trees, shrubs and sod to the Plat shall <br />be in accordance with the approved Landscape Plan referenced in the Site Plan Development <br />Permit. The DEVELOPER is ~:equired to-submit a Plan for CITY approval that identifies <br />'existing tree growth within the Plat that will be protected during construction. The trees to <br />be protected must be identified on the grading plan, and the plan must require' the installation <br />of 'tree save fences' prior to land clearing or grading. In addition, the requirement for this <br />Plan shali be fulfilled by the DEVELOPER as follows: <br /> <br />a) Minimizing the impact of construction on <br /> Extension Service publication "Protecting <br /> (Publication #NR-FO-6135-S). <br /> <br />trees in accordance with Minnesota <br />Trees From Construction Damage" <br /> <br />23. Tree Disease Prevention and Disposal. The DEVELOPER shall prevent the introduction <br /> and spread of tree disease into the residual tree populations of the Plat and adjoining <br /> properties as well as mitigate the effects of construction activity on tree health, within and <br /> outside of the Plat.
