I <br />il <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br />ii <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />Councilmember Kurak introduced the following resolution.and moved for its adoPtion: <br /> <br /> RESOLUTION #03-01-011 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0641 TO REZONE CERTAIN <br />PROPERTY FROM B-1 BUSINESS TO R-2 MEDIUM DENSITY RESIDENTIAL <br /> <br /> WHEREAS, on August 22, 2002, the City received an apPlication to rezone certain <br />property in accordance with Section 9.03.03 of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BYTHE cITy COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA.COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That Turtle Moon, Inc., hereinafter referred, to as "Applicant,'' has properly applied to rezone <br /> certain property from B-1 Business to R-2 Medium Density ReSidential. <br /> <br />o <br /> <br />That the Planning Commission conducted a public hearing pursuant to'Section 9.03.03' of the <br />City Code on October 3, 2002, and said' public hearing was properly advertised, and the <br />minutes of said public hearing are hereby incorporated by reference. <br /> <br />That the City Council met on November 12, 2002 and tabled action on the rez0ning request <br />due to the request for further information related to the proposed preliminary plat for <br />Rivenwick 3rd Addition. <br /> <br />That the property proposed to be rezoned is legally described as follows: <br /> <br />That part of Outlot B, Rivenwick, according to the recorded plat thereof, Anoka County, <br />Minnesota, which lies southerly and southwesterly of the following described line: <br /> <br />Commencing at the northeast comer of said Outlot B; thence south 00 degrees- 40 <br />minutes 48 seconds east,, assumed bearing, .filong the easterly-line of said Outlot B, 7.71 <br />feet; thence south 24 degrees 08 minutes 21 seconds west, continuing along said easterly <br />line, 416.78 feet; .thence southwesterly 428.75 feet along a. tangential curve concave to <br />the northwest having a radius of 430.00 feet and a central angle of 57 degrees 0'7 minutes <br />45 seconds to a point of compound curvature and the point of.beginning of the line to be <br />described; thence northwesterly 395:37 feet along a compound curve concave to the <br />north having a radiUs of 340.00 feet and a central angle of 66 degrees '37 minutes 33 <br />seconds; thence north 32 degrees 06 minutes 20 seconds west, tangent to:last described <br />curve, 107.22 feet; thence westerlY 3'07:79 feet alOng a tangential curve concave to the <br />southwest having a radius of 440.0.0 feet and a central angle of. 40 degrees 04 minutes 45 <br />seconds; thence north 72 degrees 11 minutes 05 seconds west., tangent to last described <br />curve, 101.18 feet; thence northwesterly 113.04 feet along a tangential. curve conCave the <br />north having a radius of 710.00-feet and a central angle of 09 degrees 07 minutes 19 <br />seconds; thence north 63 degrees 03 minutes 46 seconds west, tangent to last described <br />curve, 423.35 feet; thence northwesterly 319.00 feet along a tangential curve concave the <br /> <br />-147- <br /> <br /> <br />
