City of Belfast, 2007 ME 32, 915 A.2d 966 <br />(Me. 2007) <br />MAINE (02/22/07)-In 2004, the city of Belfast sought to revise <br />its comprehensive plan by establishing a special development <br />district witrun an existing commercial district. Prior to the revi- <br />sion, retail lots could not exceed 75,000 square feet; the plan <br />would create a new district that would allow structures up to <br />200,000 square feet. <br />. The law mandated that the comprehensive plan could be <br />amended only after "soliciting and considering a broad range of <br />public review and comment." Therefore, a series of public meet- <br />ings were held. Roop, the owner of land that abutted the new dis- <br />trict, and other lot owners within or near the district opposed the <br />change. At one of the meetings, the city planner stated that-de- <br />spite the opportunity for the public to hear and comment on the <br />amendment-the exact language of the amendment could not be <br />changed.
