From the mid-1950s to 1976, the landfill op- <br />erated under an agreement with the town; in 1976, the town stopped <br />disposing of solid waste in the landfill. <br />In 2000, the Department of Environmental Protection (DEP) issued <br />an administrative order to close the landfill in accordance with state <br />laws. Under the order, Buckley entered into an agreement with a private <br />company to perform the closure work. In 2003, however, the closure <br />had not ,been completed, and the town amended its zoning ordinance <br />with regard to landfills. The amended ordinance created a bylaw that <br />stated that a landfill could not exceed 40 feet. At the time, the landfill <br />exceeded the height limit. <br />The town building inspector issued a cease and desist order to all the <br />landfill's owners, including Buckley. Buckley had 30 days under the or- <br />der to close the landfill. Buckley appealed the order to the zoning board <br />of appeals.
