Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #07-06~_ A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT FOR THE CONSTRUCTION AND OPERATION OF A 165-FOOT TELECOMMUNICATIONS TOWER ON THE ALPINE PARK PROPERTY AND DECL~GTERMSOFSAME WHEREAS, T-Mobile Central, LLC has properly applied for a conditional use permit to construct and operate a 165-foot communications tower on a 60 foot by 40 foot section (Site) of the property generally known as Alpine Park located at 6600 Alpine Drive and legally described as follows: WHEREAS, the Planning Commission met on June 7, 2007, conducted the public hearing and recommended City Council WHEREAS, the Parks Commission met on the City Council , and recommended that NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. Based on Findings of Fact # , a conditional use permit for a 165 foot monopole tower and related equipment building is hereby granted to T-Mobile Central, LLC ("Permittee"). 2. This permit is perpetual in its duration so long as the terms imposed herein are complied with. 3. The development of the Site shall be in accordance with the approved site plan and landscaping plan, revisions dated prepared by T-Mobile. 4. The applicant will adhere to all lease provisions determined in the Lease Agreement. 5. The opaque board security fence shall be installed and maintained in accordance with the approved site plan to prevent unauthorized entry to the tower. 6. The applicant will construct a 10-foot-wide, Class 5 extension from Alpine and 153rd Court to access the property. 7. The tower will not exceed 165 feet in height. 8. The tower will not be illuminated by artificial means and shall not display strobe lights. 9. No signs will be posted on the tower, equipment building or fencing except applicable warning or equipment information signs. 16
