<br />NEW JERSEY (04/24/07)-In 2004, Rock Hill, LLC, applied for site
<br />plan approval to build a self-storage facility, driveway, and retaining
<br />wall on property it ow-ned in an industrial zone. Rock Hill was told that
<br />it would not need to apply for any variances to develop the property as
<br />planned. After a hearing, the planning board approved the application.
<br />The company that owned the adjoining property, Montessori Prop-
<br />erty Management, sued the planning board. According to Montessori,
<br />a sideyard variance was required for the construction of the proposed
<br />retaining wall and a driveway.
<br />The trial court found that the board had not afforded Montessori
<br />adequate opportunity to oppose the plan at the hearing. It voided the
<br />board's decision and ordered it to hold another hearing. However, the
<br />
