<br />CASE # i <br /> <br />PUBLIC HEARING <br />REQUEST FOR AN AMENDED CONDITIONAL USE PERMIT FOR <br />ARMSTRONG KENNELS; CASE OF CHARLES DELANEY <br />By: Amy Geisler, AICP, Associate Planner <br /> <br />Background: <br /> <br />Armstrong Kennels is located at 8404 161 5t Avenue, just west of Armstrong Blvd. The property <br />is zoned R-l Residential. In 1990, the City issued a Conditional Use Permit to the Delaneys to <br />allow an additional residential structure and to fonnally recognize the multiple uses that have <br />historically existed on the property. The Delaneys wish to build an additional accessory building <br />on their property, which requires an amendment to their CUP. <br /> <br />The following items are enclosed for your information: <br /> <br />a. Site location map <br />b. Exhibit identifying existing buildings on the property <br />c. Building exhibit <br />d. Conditional Use Permit issued in 1990 <br />e. Proposed fmdings of fact <br />f. Proposed Conditional Use Permit <br /> <br />Notification: <br /> <br />In accordance with City Code, the City attempted to notify owners of property within 350 feet of <br />the Subject Property of the public hearing and request for amendment of Conditional Use Permit. <br /> <br />Funding Source: <br /> <br />Staff time necessary to review the proposal is paid for by the applicant from the escrow <br />deposited with the land use application. <br /> <br />Observations: <br /> <br />A kennel operation and associated residential buildings has been in existence on the property <br />since 1926, and is considered a lawful non-conforming use. The original CUP issued in 1990 <br />allows for 4 residential structures in association with the kennel operation. The terms of the CUP <br />require that any expansion of the kennels requires an amendment to the original permit. <br /> <br />The Delarteys wish to construct a new 1200-square-foot metal pole barn to be used for storage of <br />equipment related to the kennel operation and the Game Fair (the Delaneys have a separate CUP <br />related to the Game Fair). The building would be located several hundred feet from any adjacent <br />property lines. With the new building, a total of 13,768 square feet of accessory buildings would <br />be inplace on the property. For comparison, City Code allows 12,000 square feet of accessory <br /> <br />49 <br />
