Approval of the building <br />foundation requires a certificate of elevation signed by a licensed (State of Minnesota), <br />professional land surveyor, verifying that the elevation complies with the approved grading <br />plan for the Plat. No occupancy permit for any lot in the Plat shall be issued until: (a) <br />vehicular access to the lot is provided including the installation of at least one layer of <br />bituminous surfacing; (b) all utilities are in place, operational and accepted by the CITY; <br />and (c) boulevard sod and landscape trees, or escrow for same, have been provided; (d) for <br />lots that have a slope of less than 2%, a certificate of grading,, prepared by a licensed (State of <br />Minnesota), professional land surveyor, must be provided to the City documenting that the <br />flattest grade on the lot is 1% or greater. <br /> <br /> · SECTION IV <br />PARK DEDICATION <br /> <br />16. Cash, Land, and Park Improvements.' The Plat is located in the Oak R-ecreation .District. <br /> Park dedication requirements shall be satisfied by a caSh payment in the amount of Eighty <br /> One Thousand Dollars and no cents ($81,000.00) (45 x $1,800). The three (3) existing <br /> homesteads are exempt from this fee. This payment shall be made to the City prior to the <br /> release of the Final Plat for recording. <br /> <br />17. <br /> <br />18. <br /> <br /> SECTION V <br />TRANSPORTATION AND LANDSCAPING <br /> <br />Park Trail Development and Fees. The City CounciI has established a trail development fee <br />in the amount of Four Hundred Seventy Five Dollars and no cents ($475.00) per lot. The <br />three (3) existing homesteads are exempt from this fee. The amount of trail fees due on the <br />Plat is Twenty One Thousand Dollars Three Hundred Seventy Five Dollars and. no cents <br />($21,375.00) (45 lots x $475.00 per lot). The DEVELOPER herein agrees to construct a <br />sidewalk along one side of the Junkite Street N.W. cul-de-sac to the common property line of <br />Lots 5 and 6 of Block 3. The DEVELOPER also agrees to construct an 8 foot wide <br />bituminous trail along the entirety of the common property line between Lots 5 and 6 of <br />Block 3. The CITY herein agrees to credit the trail development fees due on the Plat in an <br />amount equal to the surface costs associated with the trail and. sidewalk segments described <br />in this paragraph. Therefore, a payment in the amount of Dollars <br />and no cents ($. ) is due to the CITY for this Plat. <br /> <br />The DEVELOPER herein agrees to provide, the City with a separate document, in recordable <br />form, granting an easement ' <br /> <br />Sidewall{ Construction. The DEVELOPER herein agrees to construct and pave, in <br />accordance with CITY standards, a five (5) foot wide concrete sidewalk with pedestrian <br />ramps in locations prescribed by the CITY, not to exceed 5% in grade, along the east side of <br />Junkite Street N.W., and the south side of 155t~ Lane N.W. and 154th Lane N.W.
