-~28- <br /> <br />22. <br /> <br />23. <br /> <br />24. <br /> <br />25. <br /> <br />26. <br /> <br />A portion of the area north of the plat, currently platted as Outlot C, Wildlife Sanctuary 2nd <br />Addition, shall be included in the plat as an outlot and deeded to the City of Ramsey to <br />protect the wetlands. <br /> <br />Boulevard and Area Restoration. The DEVELOPER shall be responsible for the cost of <br />establishing seed in all boulevards within thirty (30) days of the completion of the street <br />improvements, and restoring all other areas disturbed by the development grading operation <br />in accordance with the approved erosion and sediment control plan. The DEVELOPER shall <br />also be responsible for the cost of cleaning any soil, earth or debris from the wetlands within <br />and adjacent to this Plat resulting from grading performed in the development of the land. <br /> <br />Temporary Cul-de-Sac Easement. A temporary cuI-de-sac shall be constructed at the <br />westerly terminus of 155th Lane N.W. and easterly terminus of 1 J4th Lane N.W. An access <br />easement is required that will expire once these streets extend beyond the boundaries of the <br />Plat. The DEVELOPER shall provide the City a copy of the access easement for their <br />review and approval. The temporary cul-de-sac will be signed as a future through street as a <br />Stage II cost. The DEVELOPER herein agrees to deposit a cash escrow with the City in the <br />amount of Four Thousand Dollars and no cents ($4,000.00) ($2,000.00 x 2 temporary cul-de- <br />sacs). The purpose of the escrow is to cover the costs to remove the temporary cul-de-sac <br />when 155th Lane N.W. is extended as a through street to the west, restore adjacent properties, <br />and extend the sidewalk to the western boundary of the Plat. <br /> <br />Lot Development Restrictions. The DEVELOPER herein agrees to establish and record at <br />the office of the Anoka County Registrar, a covenants restriction that will prohibit the <br />removal of any trees, unless they are proven to the City to be dead, dying or diseased, from <br />the west property line of Lots 13 through 17 and Outlot B of Block 4, as identified on the <br />Final Tree Plan prepared by Passe Engineering, Inc., and dated October 2, 2002, revision <br />dates November 5, 2002, and ,2003, attached hereto as Exhibit A. The purpose <br />of this restrictive covenants is to preserve the existing stand of trees to satisfy density <br />transition requirements on the Plat. <br /> <br />Fencing Of Pasture Land. The DEVELOPER herein agrees to comply with the letter of <br />understanding between Oakwood Land Development, Inc., Milt Weichelt, and Dave Mott, <br />drafted by Oakwood Land Development, Inc., and dated November 12. 2002. Said letter of <br />understanding, attached hereto as Exhibit B, establishes that the DEVELOPER will at <br />h/s/her own expense, construct an eight (8) foot high fence on the Weichelt and Mott parcels <br />to deter trespassing from the Plat onto the Weichelt and Mort properties. <br /> <br />Upgrades Required On Lot 13, Block 4. The Developer herein agrees that the exterior' <br />finish on the dwelling will be upgraded to a maintenance free type and the driveway access to <br />Junkite Street N.W. from the subject lot will be bituminous or concrete.
