By: Megan Wald, Associate Planner Background: The City Council recently approved the plat of Wildlife Sanctuary 2nd Addition. Wildlife 2nd is a replat of Lots 1, 2 and 3 of Wildlife Sanctuary Addition into 54 urban single family lots. Each of the 3 pre-existing lots in Wildlife Sanctuary contained the standard drainage and utility easements around the perimeter. With the replat of the property, all 54 lots were designed with the standard drainage and utility easements around the perimeter. The following items are enclosed for your information: a) Site location map b) Exhibit of underlying easements to be vacated c) Final plat of Wildlife Sanctuary 2nd Addition d) Proposed ordinance Notification: In accordance with State Statute, a public hearing is required to consider vacation of easements. City Staff attempted to notify property owners within 350 feet of the subject property of the public hearing to vacate easements. Observations: These easements dedicated around the perimeter of the 54 new lots cOnflict with the easements dedicated when the plat consisted of only 3 lots. The process of replatting does not vacate any pre-existing easements of record. The only way to eliminate easements of record is by City Council ordinance. Recommendation: City Staff recommends introduction of the enclosed ordinance to vacate pre-existing easements in Wildlife Sanctuary. Council Action: Motion to introduce Ordinance #03- to vacate certain drainage and utility easements in Wildlife Sanctuary.
