Wildlife 2nd is a <br />replat of Lots 1, 2 and 3 of Wildlife Sanctuary Addition into 54 urban single family lots. Each of <br />the 3 pre-existing lots in Wildlife Sanctuary contained the standard drainage and utility <br />easements around the perimeter. With the replat of the property, all 54 lots were designed with <br />the standard drainage and utility easements around the perimeter. <br />The following items are enclosed for your information: <br /> <br /> a) Site location map <br /> b) Exhibit of underlying easements to be vacated <br /> c) Final plat of Wildlife Sanctuary 2nd Addition <br /> d) Proposed ordinance <br /> <br />Notification: <br /> <br />In accordance with State Statute, a public hearing is required to consider vacation of easements. <br />City Staff attempted to notify property owners within 350 feet of the subject property of the <br />public hearing to vacate easements. <br /> <br />Observations: <br /> <br />These easements dedicated around the perimeter of the 54 new lots cOnflict with the easements <br />dedicated when the plat consisted of only 3 lots. The process of replatting does not vacate any <br />pre-existing easements of record. The only way to eliminate easements of record is by City <br />Council ordinance. <br /> <br />Recommendation: <br /> <br />City Staff recommends introduction of the enclosed ordinance to vacate pre-existing easements <br />in Wildlife Sanctuary. <br /> <br />Council Action: <br /> <br />Motion to introduce Ordinance #03- to vacate certain drainage and utility easements in <br />Wildlife Sanctuary. <br /> <br />Review Checklist: Principal City Engineer <br /> City Attorney <br /> Principal Planner <br /> <br />CC: 03/25/03 <br /> <br />-57- <br /> <br /> <br />
