CASE # <br /> <br />APPROVAL OF A REGISTERED LAND SURVEY FOR <br />PROPERTY OWNED BY TOM AND PATTIANN KURAK; <br />CASE OF TOM AND PATTIANN KURAK <br /> By: Patrick Trudgeon, AICP, Principal Planner <br /> <br />Background: <br /> <br />Tom and Pattiann Kurak, owners of approximately 120 acres north and south of Sunwood Drive are <br />preparing to sell a portion of their land to LTR Land Development, Inc. for the Village of Sunfish Lake <br />PUD. The property is registered as Torrens property and Anoka County is requiring the City approval of <br />a Registered Land Survey (RLS) of the parcel before accepting the deed. The County desires a RLS be <br />approved in order to get rid of the cumbersome legal description. <br /> <br />The following items are enclosed: <br /> a) Site location map <br /> b) Registered Land Survey <br /> c) Proposed resolution to approve proposed Registered Land Survey <br /> <br />Notification: <br /> <br />No notification is required for a RLS. It should be noted that as part of the rezoning and platting process <br />for Village of Sunfish Lake (Tract B), property owners within 700 feet were notified of public hearings <br />relating to the subdivision. <br /> <br />Observations: <br /> <br />The Registered Land Survey shows two parcels, Tract A and Tract B. The Kurak parcel consists of three <br />tax parcels. Tract A is located north of Sunwood Drive and contains the two tax parcels <br />(23.32.25.34.0003; 26.32.25.2[.0005). Tract B consists of one tax parcel (26.32.25.24.0034). As <br />mentioned above, even though the Kurak properties consists of separate parcels for tax purposes, the <br />County is requiring a RLS to be approved before they will allow the sale of one of the tax parcels. <br /> <br />The Kuraks are in the process of selling Tract B to LTR Land Development Inc. for the Village of Sunfish <br />Lake subdivision. Approving the RLS will not alter any previous approval or desigTt of the Village of <br />Sunfish Lake. It will simply clear up legal description issues in an acceptable way for Anoka County and <br />will allow LTR Land Development to purchase the land for the Village of Sunfish Lake development. <br /> <br />Recommendation: <br /> <br />City Staff recommends that Council approve the Registered Land Survey. <br /> <br />Council Action: <br /> <br />Motion to adopt Resolution #03-03- <br />Kurak property. <br /> <br />__ approving a Registered Land Survey for the Tom and Pattiann <br /> <br />Reviewed by: <br />Community Development Director <br /> <br />Copies to: <br />City Attorney <br /> <br />CC: 03/25/03 <br /> <br />-67- <br /> <br /> <br />
