<br />reguhited by the City without cost to such fund. In no event shall the required percent be <br />greater than that amount allowed by Chapter 349 of Minnesota Statutes. Disbursements <br />from this fund shall be for lawful purposes as determined from time to time by Council <br />resolution. The term "net profits" as used herein shall be defined as profits less amounts <br />expended for allowable expenses. "Allowable expenses" as used herein shall not include <br />those "lawful purpose" expenditures defined by Chapter 349 of Minnesota Statutes <br /> <br />7.61.10 Expenditures for Lawful Purposes Within City's Trade Area <br /> <br />Any organization holding a premises permit to conduct lawful gambling within the City <br />shall be required to expend 75% of its "lawful purpose" expenditures on lawful purposes <br />conducted or located within the City's trade area and to the benefit of the City's trade area. <br /> <br />A detailed quarterly report of the expenditures for lawful purposes within the trade <br />area shall be provided to the Finance Officer on or before January 15, April 15, July <br />15 and October 15 of each year after the date of the adoption of this chapter. Any <br />organization that fails to submit a detailed quarterly "Lawful Purpose <br />Expenditure" Report of how the required 75% was expended, will be brought <br />before City Council to discuss possible future revocation of their premise permit. <br /> <br />In the event the City is unable to determine with a reasonable degree of certainty.that the <br />required 75% oflthe lawful purpose expenditures 6fthe organization holding a premises <br />permit to condurt lawful gambling within the City's trade area is being expended on <br />lawful purposes,ithe City Administrator may require such other financial information as is <br />reasonably necessary for the City to make this determination. <br /> <br />;: p::::,e; oflthi" Slibseeuoft, the temllr:-re ",ea i" derrned as ~ Citie" of ~"r.: <br />~ :~~;~c~ve , and the TO:\'R of Bums }~ Anoka ~ounty, the CIty of Elk Rr/cr I.n <br />h uJty and the Cl:ty of Dayton III Hennepm Coooty. For purposes of thIS <br />subseetion, the term "la\vful purpose(s)" is that definition assigned to it by Minnesota <br />Statutes, Chaptet 319. This subsection shall apply to all organizations holding a premises <br />permit to eondu~t la'.vful gambling within the City. <br />I <br />SECTION 3. VIOLATIONS <br /> <br />Anyone who violates the provisions of this section shall be guilty of a misdemeanor. This <br />section does not preclude civil and criminal penalties under applicable laws. Failure to file <br />timely reports and payments as required by this section may result in a recommendation to the <br />Board that the organization's premises permit should be revoked. <br /> <br />SECTION 4.
