<br />CASE # 3 <br /> <br />ADOPT ORDINANCE TO VACATE DRAINAGE AND UTILITY EASEMENTS <br />IN BROOKFIELD FIRST ADDITION; <br />CASE OF OAKWOOD LAND DEVELOPMENT <br />By: Amy Geisler, AlCP, Associate Planner <br /> <br />Background: <br /> <br />Oakwood Land Development has received final plat approval for the 1 st and 2nd Additions of <br />Brookfield. Drainage and utility easements were established in both plats to cover the utility <br />lines. Since then, a sanitary forcemain has been relocated slightly, so that an adjustment is needed <br />to the easements. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Brookfield 1 st Addition <br />Exhibit of underlying easements to be vacated <br />I. <br />Proposed ordmance <br /> <br />Notification: <br /> <br />In accordance with State S~atute, City Staff attempted to notify property owners within 350 feet <br />of the subject property oftl}e public hearing to vacate easements. <br />I <br /> <br />Funding Source: <br /> <br />Staff time necessary to review the proposal is paid for by the applicant from the escrow deposited <br />with the land use applicati6n. <br /> <br />Observations: <br /> <br />The applicant is requesting that all the drainage and utility easements on Outlot E of Brookfield <br />1 st Addition be vacated, tmd re-established correctly through the recording of Brookfield 2nd <br />Addition. Staff recommen~s that the easement be vacated. <br /> <br />City Council conducted a public hearing and introduced the proposed ordinance on May 22, <br />2007. <br /> <br />Recommendation: <br /> <br />In accordance with City Charter provisions, City Staff recommends adoption of the ordinance. <br /> <br />-105- <br />
