Case # <br /> <br />PUBLICATION OF SEWER AND WATER EXTENSION TO <br />OAK TERRACE ESTATES (I.P. #02-40) <br /> By: Steven J. Jankowski, City Engineer <br /> <br />Background: <br /> <br />In November of 2002, Oak Terrace Estates, the mobile home park along Highway 10, petitioned <br />the City for a feasibility study to determine the costs and financing for the extension of City <br />sanitary sewer and water. This feasibility study was presented to the Council on March 25, <br />2003, and a copy has been attached to this case. <br /> <br />The proposed improvements are feasible within the financing scenario presented in the report. It <br />should be noted that the report recommends that drainage improvements should be undertaken <br />along ,;vith the sewer and water to eliminate an existing problem just south of the railroad tracks. <br /> <br />The financing for this project would come through special assessment to Oak Terrace Estates <br />under Minnesota Statute 429 and City Code 4.60.. A public hearing needs to be held on this <br />project as a requirement of these statutes. Following the public hearing, the Council may direct <br />modifications to the feasibility study which shall then become basis for the improvement project. <br /> <br />According to City Code 4.60, no further action may be taken on this project for a 60 day period. <br />Following the close of this public hearing, unless a waiver of this waiting period is agreed to by <br />all properties proposed to be assessed. There is some question as to whether Sunfish Properties, <br />which is located east of the mobile home park is benefitted property. Although the sanitary <br />sewer must be extended westward through their property to reach Oak Terrace Estates, their <br />property is presently serviced with both sewer and water. Sunfish Properties has agreed to <br />extend this sanitary sewer at their expense at such time as an anticipated frontage road is <br />constructed (see Development Agreement in Appendix B, paragraph 1 9). Sunfish Properties has <br />been notified of tonight's public hearing, and has been furnished with a copy of the feasibility <br />study. <br /> <br />Recommendation: <br /> <br />Further action on the project will require some cooperation between Oak Terrace Estates and <br />Sunfish Lake Properties concerning the issues of drainage. The cost of extending the sanitary <br />sewer through Sunfish Properties is also somewhat ambiguous. -Therefore, Staff recommends <br />that the Council close the public hearing and direct these two parties to negotiate these two. <br />issues. Further action can be considered by the Council at such time that an agreement, is <br />reached by these two parties, or the sixty-day period has passed. <br /> <br />-149- <br /> <br /> <br />
