-172- <br /> <br />5. Access From Trunk Highway #10. The DEVELOPER herein agrees that right-of- <br />access along T.H. #10 adjacent to the subject property (with the exception of points of access as <br />granted by the State of Minnesota) shall be dedicated to the State of Mirmesota <br /> <br />6. Pedestrian/Bicyclist Path. The DEVELOPER agrees to construct, in accordance with <br />City standards, an eight (8) foot wide bituminous pedestriardbicyclist path, not to exceed 5% in <br />grade nor 2% cross sectional, parallel to Sunfish Lake Blvd. The DEVELOPER shall also <br />provide approved tuff establishment in conjunction with the path construction within the subject <br />Plat similar to that which is approved for the building site. The construction plans for said paths <br />are subject to the prior approval' of the City Engineer. <br /> <br />7. Stormwater Management Fee. The City has enacted a Stormwater Management Fee <br />and the current rate is Three Thousand Seven Hundred Forty One Dollars ($3,741.00) per <br />commercial acre. The amount of Stormwater Management Fee due 6n the '3.8-acre ,parcel is <br />fourteen thousand two hundred fifteen dollars ($ I4,215). A cash payment will be required prior <br />to the City releasing the Final Plat for recording. <br /> <br />8. Sewer and Water Trunk Fees. Sewer and water trunk charge fees in the amount of <br />$28,530 shall be paid prior to the City releasing the final plat for recording. These fees represent <br />the remaining balance due to the City the sewer and water trunk charges. <br /> <br />9. Sewer and Water Lateral Extensions. The developer shall cause the watermain to be <br />extended to the west property line. The sanitary sewer shall be extended westward so as to <br />provide services to Lot 1. The extension of the sanitary sewer to the west property line will not <br />be required until such time as the access road is constructed. At such time, the owner(s) of Lot 1 <br />shall be responsible for the cost of extending the sanitary sewer to the west property line. The <br />Developer agrees to disclose this requirement at the time of sale of Lot 1. <br /> <br /> II. <br />BUILDING PERMITS AND CERTIFICATE OF OCCUPANCY <br /> <br />10. Requirements for Building Permits. No building permit for any lot in the Plat shall be <br />issued until (a) site plan approval is granted by the CITY and any expense incurred in giving site <br />plan approval has been reimbursed to the CITY; (b) the Building Official has been provided <br />with a copy of the approved site plan, signed by a registered architect or surveyor, showing all <br />dimensions to scale; (c) the Plat has been recorded at Anoka County Property Records. <br /> <br /> III.. <br />PARK DEDICATION <br /> <br />11. Park Dedication Requirements.
