I <br /> I <br /> I <br /> I <br /> I <br /> <br /> I <br /> I <br /> I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />CASE <br /> <br />REQUEST FOR AN EXTENSION TO THE CONSTRUCTION TIMELINE FOR A <br />TRANSFER STATION ESTABLISHED IN THE DEVELOPMENT PERMIT; <br />CASE OF ACE SOLID WASTE <br /> By: Megan Wald, Associate Planner <br /> <br />Background: <br /> <br />The City approved a site plan for ACE Solid Waste to develop an office/truck terminal and <br />transfer station for mixed solid waste and recyclable materials in year 2000 on the property <br />located at 6601 McKinley Street NW. <br /> <br />The following items are enclosed for your information: <br /> <br />Site location map <br />Approved Site Plan <br />Approved Development Permit for ACE Solid Waste <br />Letter from Mike Berkopec, Business Manager for ACE Solid Waste <br />Proposed Resolution <br /> <br />Notification: <br /> <br />City Code does not require a public hearing to consider extending the time frame to a <br />Development Permit'. <br /> <br />Observations: <br /> <br />City Council approval of the site plan for the new home of ACE Solid Waste consisted of two <br />phases, the office and truck terminal facility and a transfer station for mixed solid waste and <br />recyclables. The site plan Development Permit stipulates that construction of phase one (office <br />facility) must be completed by May' 30, 2001 and phase two (transfer station) must be completed <br />by May 30, 2003. As you know ACE Solid Waste has been operating from their Ramsey facility <br />for the past two years. However, due to business economic decisions construction of the transfer <br />station has not been initiated. <br /> <br />City Code requires a conditional use permit to be obtained in order to operate a transfer station of <br />mixed solid waste and recyclables in Ramsey and ACE Solid Waste properly applied for the <br />conditional use permit in 2000. A standard conditional use permit would require the permit to be <br />initiated within one year of approval or the conditional use permit would become null and void. <br />However, ACE Solid Waste asked that the one-year initiation requirement be waived as they <br />would be unable to construct the transfer station within one year after approval of the conditional <br />use permit. The City Council granted the conditional use permit to ACE Solid Waste on April <br />25, 2000 without the one-year initiation requirement .... <br /> <br />-191- <br /> <br /> <br />
