I II I I I I I I I I I I I I I I I I CASE # 8 REQUEST FOR A HOME OCCUPATION PERMIT; CASE OF FLORENCE KAHLSTORF By: Megan Wald, Associate Planner Background: The City received an application from Janis Day for a home occupation permit to establish a massage therapy business in her home on the property located at 7136 159th Lane. The following items are enclosed for your information: a) b) c) c) d) Site location map Business Proposal Draft Planning Commission meeting minutes dated May 1, 2003 Proposed Findings of Fact Proposed Home Occupation Permit Notification: In accordance with State statute, Staff notified property owners within 350 feet of the subject property of the public hearing. Observations: Florence Kahlstorf is proposing to establish a one-person massage therapy business in her home. City Code restricts home occupations to 20% of the gross floor area of the home. The room in which the home occupation will take place is 312 square feet (24 x 13) in size, which equates to 10% (312 / 2,872) of the gross floor area. Florence will be the sole employee and she expects to service a maximum of 1-2 clients per day. She would like to operate Monday- Sunday 7:00am - 9:00pm. The in home massage therapy business will be secondary to her main employment as a massage therapist in a clinic or chiropractic office. The City has issued several similar home occupation permits in the past. The Planning Commission held a public hearing and reviewed the proposed home occupation request at their May 1, 2003 meeting. There was no citizen input during the public hearing. Recommendation: The Planning Commission recommended that the City Council approve the home occupation request for Florence Kahlstorf. -207-
