Critical Area Plan has been conditionally approved by the DNR as part of the City's <br /> LCP." <br /> <br />The summary of environmental impacts, on page 14-2, should acknowledge that there will be a <br />stormwater outfall to the Mississippi River within the Corridor in one location or another <br />because of the RTC site. <br /> <br />Regarding the asterisked paragraph on page 14-4, Executive Order C. 1. a. (8) requires <br />preparation of criteria for control of noise, and does not specifically state that it is required for <br />plans. This is a standard that we would look for consistency throug~h city-wide or Corridor <br />ordinances, not plans. Because local units of governments shall permit development only in <br />accordance with adopted plans and regulations and the DNR approval, the list of Executive Order <br />standards submitted by DNR include those that must be assured by implementation of the Plt~n <br />and regulations. Please omit the asterisk on page 14-3 and the paragraph explanation on <br />expected Plan amendments, as it is not needed. <br /> <br />On the stated assertion that the "project does not directly affect the Critical Area," on page 14-4, <br />last paragraph, if there will be a discharge to the Mississippi River because of this project, the <br />project does directly affect the Critical Area, which should be acknowledged. <br /> <br />For any lands within the Critical Area/WSR/MNRRA Corridor under the county's jurisdiction <br />that may be affected by discharge, stormwater management, or wetland mitigation of the RTC <br />project, the County is subject to the same state Critical Area laws for local units of government. <br />The County's Critical Area Plan was conditionally approved March 14, 2002, including a <br />condition that "all future uses, development, management, transportatiOn, utility, parks, <br />recreation, and capital improvement and public facility programs affecting lands under county <br />jurisdiction within the ... Corridor shall be consistent and permitted only in accordance With the <br />County's Plan, the standards and guidelines of Executive Order 79-19, and other applicable local, <br />state, and federal laws, whichever is more restrictive." For clarification, the last paragraph, the <br />last sentence on page 14-4 should include the following: <br /> "The City will also work with Anoka County Parks to imp!ement these standards and the <br /> County's DNR-conditionall¥ approved MNRRA/Critical Area Plan within MRP land <br /> controlled by the County." <br /> <br />Section 15. 14/ater Surface Use <br /> <br />While we appreciate that much has been done to minimize runoff from the developed site, we <br />encourage additional effort to achieve pre-development volumes of runoff entering the Mississippi <br />River. <br /> <br />-197- <br /> <br /> <br />
