<br />Councilmember Elvig stated if this is sold out as parcels they have to come through the City as <br />far as process and planning. Whether they have a Master Development Agreement or not, there <br />is a plan and a resolution about that plan. There are political careers hanging in the balance to <br />build this project out. There is a huge commitment and a lot of money into this project. It seems <br />if the bank wants to work together with the City they stand a better chance by working forward <br />and pro actively than trying to parcel this out. If they start throwing out legal lawsuits it would <br />string this out for a long period of time. People will not want to purchase this property if the <br />City is very ornery about it. There are a lot of things they can do to start throwing strategy <br />around if that is what they want to do. <br /> <br />Mr. Bray stated the property remains subject to the City's zoning code, and his recollection is <br />that the plan is a part of the zoning of this property. The zoning of this property specifically <br />references this plan and to develop contrary to the plan would require a zoning amendment. <br /> <br />Councilmember Elvig questioned if the State will become involved and determine that the <br />assessments are gone on the parking ramp. <br /> <br />Mr. Bray replied the assessments have been levied and that is now outside the scope of the <br />Master Development Agreement. <br /> <br />Mayor Gamec requested clarification that the assessments will have to be paid regardless of who <br />owns the property. <br /> <br />Mr. Bray replied anyone can make a challenge, but State law is clear that there are 30 days to <br />challenge assessments. These assessments have been levied for two years now. <br /> <br />Public Works Director Olson presented a map depicting the Ramsey Town Center Properties in <br />Foreclosure. He reviewed the properties owned by Crest View and PSD. <br /> <br />Mr. Bray advised the properties that are not under foreclosure could be subject to mechanics <br />liens. <br /> <br />Councilmember Elvig inquired about the acres of parkland versus open ground for sale at this <br />point. <br /> <br />Mr. Russ Bushman, MinnWest Bank Central, replied there are 150 acres total, with 31 acres of <br />parkland and 11 acres of wetland. <br /> <br />Councilmember Dehen noted ifthel proceed with the declaratory judgment action it is not likely <br />that there will be a ruling by July 9 . <br /> <br />Mr. Bray advised anyone that acquires the property at the foreclosure sale would be subject to <br />the outcome of the litigation. <br /> <br />City Council Work Session / June 5, 2007 <br />Page 4 of 12 <br />
