CASE # I
REQUEST FOR AN AMENDED CONDITIONAL USE PERMIT FOR
ARMSTRONG KENNELS; CASE OF CHARLES DELANEY
By: Amy Geisler, AICP, Associate Planner
Background:
Armstrong Kennels is located at 8404 161 Avenue, just west of Armstrong Blvd. The property
is zoned R -1 Residential. In 1990, the City issued a Conditional Use Permit to the Delaneys to
allow an additional residential structure and to formally recognize the multiple uses that have
historically existed on the property. The Delaneys wish to build an additional accessory building
on their property, which requires an amendment to their CUP.
The following items are enclosed for your information:
a. Site location map
b. Exhibit identifying existing buildings on the property
C. Building exhibit
d. Letter from resident
e. Draft Planning Cominission meeting minutes dated June 7, 2007
f. Conditional Use Permit issued in 1990
g. Proposed Findings of Fact
h. Proposed amended Conditional Use Permit
Notification:
In accordance with City Code, the City attempted to notify owners of property within 350 feet of
the Subject Property of the public hearing and request for amendment of Conditional Use Permit.
Funding Source:
Staff time: necessary to review the proposal is paid for by the applicant from the escrow
deposited with the land use application.
Observations:
A kennel operation (and associated residential buildings) has been in existence on the property
since 1926, and is considered a lawful non - conforming use. The original CUP issued in 1990
allows for 4 residential structures in association with the kennel operation. The terms of the CUP
require that any expansion of the kennels requires an amendment to the original permit.
The Delaneys wish to construct a new 1200 - square -foot metal pole barn to be used for storage of
equipment related to the kennel operation and the Game Fair (the Delaneys have a separate CUP
related to the Game Fair). The building would be located several hundred feet from any adjacent
property lines. With the new building, a total of 13,768 square feet of accessory buildings would
—165—
